Mattila's main concern was that the docking area is <br />concealed from Hwy 88. The City Forester reviewed the plan and felt Black Hills <br />Spruce is the preferred choice for screening. Benke noted uneasiness with the screening <br />proposal and the small planting area reserved for the spruce trees. Williams added that <br />the maturing spruce trees could eventually interfere with parking and snow removal. <br />Mattila said one option is for the applicant to work with the State to receive permission <br />to plant into the ROW. Williams said a mass of dense shrubbery could accomplish the <br />same purpose as the spruce trees. Benke said the screening needs to be addressed in the <br />conditions of approval, and feels additional plantings are needed at the southeast <br />boundary to provide screening from the McDonalds drive-through. <br /> <br />Motion by Williams, seconded by Larson, to APPROVE LP-308, SUBJECT TO THE <br />FOLLOWING CONDITIONS: <br />1. APPROVAL OF GRADING/DRAINAGE AND UTILITY PLANS BY THE <br />CITY ENGINEER. <br />2. AMEND THE LANDSCAPE PLAN BY ADDING A ROW OF PINK <br />SPIRE CRAB ALONG THE SOUTH PROPERTY LINE, AND REPLACE <br />THE FOUR BLACK HILLS SPRUCE AT THE CORNER OF CAMPUS <br />DRIVE AND OLD HWY 8 WITH FOUR REDMOND LINDENS. <br />3. PROVISION OF A BOND OR LETTER OF CREDIT COVERING 100% <br />OF THE COST TO INSTALL CURBING, PAVING, AND <br />LANDSCAPING ON THE SUBJECT SITE. <br />4. THE ADDITION OF A SCREEN OF BLACK HILLS SPRUCE OR <br />OTHER SUITABLE PLANT MATERIAL TO PROVIDE YEAR ROUND <br />SCREENING OF THE LOADING AREA FROM HIGHWAY 88; AND <br />ADDITIONAL PLANTINGS AT THE SOUTHEAST BOUNDARY TO <br />PROVIDE SCREENING FROM THE MCDONALDS DRIVE THROUGH; <br />SUBJECT TO CITY APPROVAL. <br /> <br />4 Ayes - 0 Nayes, Motion Carried. <br /> <br />Community Development Director Kevin Locke presented the acquisition of TIF #25 by <br />eminent domain. lEG entered into a redevelopment agreement to complete the <br />Lakeview Business Park. The initial phase involves a 46,746 sq. ft. office/showroom. <br />Phases 2 and 3 each involve structures of 80,000 sq. ft. with a $2,400,000 minimum <br />value; and 40,000 sq. ft. with a $1,320,000 minimum value, respectively. The City is <br />respon.'lible in acquiring all or part of the needed parcels before August 1. The Day and <br />Plocienik properties, which are located between the Pletcher and Chenoweth parcels, <br />will be the future location of the Phase 2 and 3 structures. A portion of the Pletcher <br />property will be acquired to accommodate the Campus Dr. extension. <br /> <br />Staff requests authorization to use eminent domain to acquire the site for lEG in order to <br />insure the City meets it'l obligations of the agreement. This would give staff authority to <br />use condemnation if negotiations were unsuccessful. Benke asked if negotiation.'l are <br />underway for these parcels. Locke said negotiations are in the beginning stages and <br />appraisals are nearly complete. The intent is to complete acquisition by late summer. <br /> <br />Benke asked if the site grading requires removal of the Ploceinik home, and if the <br />owners could remain during this process.
