<br />RESOLUTION NO. 87-~ <br /> <br />~ <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />~ <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND ORDERING CORRECTION OF CODE VIOLATIONS <br />AT BEISSWENGER HARDWARE, 1390 HIGHWAY 8. <br /> <br />WHEREAS, on February 19, 1987, the City of New Brighton issued notice <br />and orders to correct code violations at the Beisswenger Hardware property <br />and; <br /> <br />wBEREAS, Mark Beisswenger, owner of Beisswenger Hardware, appealed the <br />notice and orders to the New Brighton City Council on March 12, 1987; and <br /> <br />WHEREAS, a hearing was held before the New Brighton City Council April <br />14, 1987 to consider Mark Beisswenger's appeal and; and Mark Beisswenger <br />appeared before the City Council, and; <br /> <br />WHEREAS, Mark Beisswenger offered no evidence that the statement of <br />violations were not factual. <br /> <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City Council makes <br />the following Findings of Fact: <br /> <br />1. Mark Beisswenger did not question or provide any evidence <br />questioning the accuracy of the statement of violations. <br /> <br />2. The Beisswenger Hardware Building is in deteriorated and obsolescent: <br />condition and in violation of the Life Safety Code, Uniform BUilding: <br />Code, Minnesota Uniform Code and Electrical Code. <br /> <br />THEREFORE BE IT FURTHER RESOLVED that the following code violations are <br />ordered to be corrected by the dates indicated; <br /> <br />1. Means of egress from the lower level requires two separate exits to , <br />the exterior of the building per section 25-2.4.1 of the Life safetyl <br />Code. Chapter 101 of the N.F.P.A. hereafter referred to as (LSC). <br />The two required exits on this level do not meet the code for the <br />following reasons. The ramp exit to the south end is steeper than a: <br />ratio of 1.8 per section 5-2.5.2 (LSC) and the exit stairway to the: <br />east side is open to the repair shop which is classified as a . <br />hazardous area per section 25 and 4-2 of the (LSC). The corrections! <br />must be started on May 28 and completed by August 30, 1987. <br /> <br />2. Exiting on both levels exceeds the 100 foot travel requirement as <br />stated in section 25-2.6 (LSC). These corrections must be started <br />by May 28 and completed by August 30, 1987. <br /> <br />3. All required exits from each level do not have proper exit <br />illumination nor exit signs as required by sections 25-2.8, 25-2.9 <br />and 25-2.10 (LSC). These corrections must be started by May 28 and <br />completed by August 30, 1987. <br /> <br />4. Headroom is not sufficient from exit aisle in lower level of storag~ <br />room under the upper level ramp per section 5-1.4 (LSC). <br />Reconstruction of catwalk in storage area to eliminate low headroom. <br />from aisle below is needed. These corrections must be started by <br />May 28 and completed by August 30, 1987. <br /> <br />5. The interior finish for all walls and ceilings shall be in <br />accordance with section 6-5 (LSC). These corrections must be <br />started by May 28 and completed by August 30, 1987. <br /> <br />6. The oil burner furnace room cannot be used for storage and both the! <br />oil and coal furnace rooms and the coal bin must be separated from <br />the sales areas and each other as required for 1 hour fire resistiv~ <br />assemblies, per section 25.3.2 (LSC) and Chapter 42 of the Uniform <br />Building Code, 1982 Edition. These corrections must be started by <br />May 28 and completed by August 30, 1987. <br /> <br />7. All openings and penetrations of rated walls and ceiling assemblies; <br />shall be protected as set forth in the Uniform Building Code, 1982 <br />Edition, Chapter 43 and the Life Safety Code Sections 6-3.4.1 and 6r <br />
