<br />".'.!., .!, <br /> <br />. <br /> <br />" <br /> <br />RESOLUTION NO. 87-16 <br /> <br />RESOLUTION ESTABLISHING PROCEDURES <br />FOR THE CONSIDERATION OF APPEALS <br />OF DETERMINATIONS OF RELOCATION PAYMENTS <br /> <br />BE IT RESOLVED, By the City Council of the City of New <br /> <br />Brighton that the following procedures shall be followed in the <br /> <br />consideration of appeals of determinations of relocation payments <br /> <br />pursuant to Minnesota Statutes Sections 117.50 to ll7.56. <br />1. Initial Determination. Upon submission by an applicant for <br /> <br />relocation benefits ("Applicant") of an application for <br /> <br />relocation payments, the responsible department head shall <br /> <br />make an initial determination as to the entitlement of the <br /> <br />Applicant to payment of the amount requested. <br /> <br />I f the <br /> <br />department head determines that the Applicant is entitled to <br /> <br />the amount claimed, a recommendation to that effect shall be <br /> <br />forwarded through the City Manager to the City Council. <br /> <br />Upon receipt of such recommendation, the City Council may <br /> <br />accept the recommendation and approve the relocation claim <br /> <br />or may direct that the Applicant be notified of the disap- <br />proval of the claim or any part thereof. <br /> <br />2. Notification of Disapproval of Claim. Upon the determina- <br />tion by the department head or upon the decision of the City <br /> <br />Council that a claim, or any part thereof, is disapproved, <br /> <br />the Applicant shall promptly be notified in writing by the <br />responsible department head of the disapproval and of the <br />right to appeal such determination. The notification shall <br /> <br />be accompanied by a copy of this resolution, and shall be <br />
