<br /> <br />, <br />II <br />: 1 <br /> <br />RESOLUTION No. <br />06-067 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />LUTlON MAKING FINDINGS OF FACT AND ApPROVING SP 2006-009. <br /> <br />W REAS, an application for a Special Use Permit has been made by John Ordway of <br />Pratt Ordway Properties on behalf of Limu Coffee, and <br /> <br />REAS, the procedural history of the application is as follows: <br />1. An application for a Special Use Permit was filed with the City of New <br />Brighton on June 1,2006, and <br />2. The Planning Commission, pursuant to published and mailed notices, held a <br />public hearing on June 20, 2006 and all present were given a chance to freely <br />speak at the hearing. <br />3. The Planning Commission voted 5~0 to approve the plan labeled "Alternate <br />Plan 3" provided by the applicant. <br />4. The City Council reviewed the request and the Plam1ing Commission's <br />recommendation on June 27, 2006 and tabled the application as additional <br />alternative plans were provided by the applicant that City Staff had not yet <br />reviewed. <br />5. The City Council reviewed the request again on July 25, 2006. <br /> <br />W REAS, the Planning Commission and Council make the following Findings of Fact <br />with respect to SP 2006-009: <br />1. The subject site is zoned B-4, Downtown Business District. <br />2. The applicant is requesting a Special Use Permit to amend the existing <br />General Development Plan for Main Street Village to allow construction of a <br />drive.thru lane for the existing coffee shop known as Limu Coffee. <br />3. As specified in Section 8-130 of the New Brighton Zoning Ordinance, no <br />special use shall be recommended by the Planning Commission unless such <br />shall find: <br />a. That the establishment, maintenance, or operations of the special <br />use will not be detrimental to or endanger the public health, safety, <br />morals, comfort of general public. <br />b. That the special use will not be injurious to the use and enjoyment <br />of other property in the immediate vicinity for the purposes already <br />permitted, nor substantially diminish and impair property values <br />within the neighborhood. <br />c. That the establishment of the special use will not impede the <br />normal and orderly development and improvement of the <br />surrounding property for uses permitted in the district. <br />d. That adequate utilities, access roads, drainage and/or necessary <br />facilities have been or are being provided. <br /> <br />I' <br />
