<br />h <br /> <br />., <br /> <br />" <br /> <br />RESOLUTION NO. 86-120 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION GRANTING THE MENGELKOCH COMPANY AN OFFENSIVE TRADES LICENSE AND <br />AFFIXING CERTAIN CONDITIONS OF OPERATION <br /> <br />WHEREAS, the City of New Brighton is responsible for the general <br />safety, health, welfare and well-being of its residents and has <br />establ ished codes to aid in carrying out this responsibi 1 ity; and <br /> <br />WHEREAS, City Code Chapter 24 entitled Sewer Department <br />Regulations and Chapter 15, Article VII, entitled Offensive, Dangerous <br />Trades, and Metropolitan Sewer Board Rules and Regulations for the <br />Metropolitan Disposal System and the Minnesota Pollution Control Agency <br />Regulations all apply to the operation of the Mengelkoch Company as a <br />rendering business; and <br /> <br />WHEREAS, the City is aware and has been informed that certain <br />deficiencies in the operation of the Mengelkoch Company have occurred in the <br />the past with respect to these codes, rules, regulations and standards; and <br /> <br />'WHEREAS, the deficiencies which previously existed in regard to <br />disposal of sewage have, in the past, affected the safety, health, welfare <br />and well-being of the City's residents in that such deficiencies cause <br />plugging of the sanitary sewer and lift station, interference with <br />sanitary sewer service to others, dumping of raw sewage on the open <br />ground, and emission of offensive odors in the neighborhood; and <br /> <br />WHEREAS, on January 14, 1986, a stack emission test, in <br />conformance with American Society for Testing Materials Method (ASTH) <br />0-1397-57, was performed on the emission from the stack of the Hengelkoch <br />Company plant facilities at 119-14th Street N.E. and such test indicated an <br />average odor level of 16.0 odor units per cubic foot, which is below the <br />limit of 150 odor units allowed by APC-9. Further, that the test <br />indicated a total emission rate of 323,500 odor units per minute which is <br />within the limit of one million odor units per minute allowed by APC-9; <br />and <br /> <br />WHEREAS, a second emission test was performed on July 28, 1986, <br />which indicated an average odor level of 12.0 odor units per cubic foot <br />and a total emmission rate of 244,800 odor units per minute. These <br />figures are less than the limit of 150 odor units per minute allowed and <br />less than one million odor units per minute by APC-9; and <br /> <br />NOW THEREFORE BE IT RESOLVED, that the Offensive Trades License <br />of the Mengelkoch Company for the premises at 119-14th Street N.E. be <br />granted under the following conditions: <br /> <br />I. All doors and windows shall be kept closed during periods of <br />operation so that all rendering plant air will be processed <br />through a scrubber, except during periods of loading and <br />unloading when loading doors may be open but these periods shall <br />be kept to a minimum. <br /> <br />2. The Mengelkoch Company shall continue to perform all obligations <br />required of it by its agreement with the City of New Brighton <br />dated January 25, 1977, and as amended by a subsequent agreement <br />dated December 23, 1978. <br />
