<br />iq <br /> <br />II' <br /> <br />'. ;\ <br /> <br />RESOLUTION NO. 86-72 as Amended <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />!,AMENDED RESOLUTION MAKING FINDINGS OF FACT APPROVING NC-71. <br />i; <br /> <br />!: WHEREAS, an applIcation for a nonconformIng use permit was made by <br />,! Chenoweth Greenhouses; and <br /> <br />il <br />~ ! <br />.. <br />~ l <br />~ ~ <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. That an application for a nonconfonmlng use permit was filed with <br />the City on July 11, 1986. <br />2. That the Planning Commission, pursuant to published and mailed <br />notices, held a public hearIng on July 15, 1986, all persons present <br />at the hearIng were given an opportunity to be heard. <br />3. That the application for a nonconformIng use permit was reviewed <br />by the City Council on July 22, 1986 and that the comments and <br />analysis of staff and the Planning Commission minutes and <br />recommendations were considered. <br />4. That the City Council amended Resolution 86-72, regarding NC-71 , <br />on September 9, 1986 to include findings of fact that on-site <br />construction also involved construction of an addition onto a <br />watchman's dwelling. <br /> <br />J! NOW THEREFORE BE IT RESOLVED by the City Council that the following <br />I Findings of Fact are made In respect to NC-71. <br /> <br /> <br /> 1. <br /> 2. <br /> 3. <br />I 4. <br />i; <br /> <br />1,' <br /> <br />i <br /> <br />:; <br /> <br />That the site is zoned 1-1, light indisutrial. <br />That the site has the following uses: I.) Retail floral shop, <br />2.) Greenhouses, 3.) One dwelling for watchman. <br />That on-site construction involves the following: 1.) <br />ConstructIon of new greenhouses, 2.) Remodeling and addition to <br />the watchman's dwelling. <br />That the site has the following Type IV nonconformlties: <br />a. Less than required 15 foot side yard setback. <br />b. Less than required 40 foot front yard parking and garden <br />center setback. <br />c. Lock of concrete curbing in a portion of front yard parking <br />area. <br />d. Less than required parkIng. <br />e. Lack of front yard landscaping. <br />5. That the applicant has shown the total number and extent of the <br />nonconformities will be addressed as follows: <br />a. Provide additional parking. <br />b. Complete the curbing around all front yard parking areas. <br />c. Increase the side yard setback to 21 feet over 93 feet of the <br />existing nonconformIng setback. <br />d. Reduce the size of the temporary garden center. <br />e. Eliminate parking in the front yard setback and increase front <br />yard green space. <br />6. That the applicant has done everything practical to reduce the <br />existing Type IV nonconformitles at this time. <br />7.
