<br />1"--.... <br /> <br />I: ',' ., <br />J <br />" <br /> <br />.~ ":) <br /> <br />RESOLUTION NO. 86-72 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />" <br /> <br />i' RESOL UT ION MAK I NG FI NO I NGS OF FACT APPROV I NG NC- 71. <br />I <br />, <br /> <br />WHEREAS, an application for a nonconforming use permit has been <br />made by Chenoweth Greenhouses; and <br /> <br />WHEREAS. the procedural history of the application is as follows: <br /> <br />~ ; <br />~ ~ <br /> <br />1. That an application for a nonconforming use permit was filed with <br />the City on July 11, 1986. <br /> <br />2. That the Planning Commission, pursuant to published and mailed <br />notices, held a pUblic hearing on July 15, 1986, all persons present <br />at the hearing were given an opportunity to be heard. <br /> <br />3. That the application for a nonconforming use permit was <br />reviewed by the City Council on July 22, 1986 and that the <br />comments and analysis of staff and the Planning Commission <br />minutes and recommendations were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council that the <br />following Findings of Fact are made in respect to NC-71. <br /> <br />1. That the site is zoned I-I, light industrial. <br /> <br />2. That the site has the following type IV nonconformities: <br />a. Less than required 15 foot side yard setback. <br />b. Less than required 40 foot front yard parking and <br />garden center setback. <br />c. Lack of concrete curbing in a portion of front yard <br />parking area. <br />d. Less than required parking. <br />e. Lack of front yard landscaping. <br /> <br />3. That the applicant has shown the total number and extent of the <br />nonconformities will be addressed as follows: <br />a. Provide additional parking. <br />b. Complete the curbing around all front yard parking areas. <br />c. Increase the side yard setback to 21 feet over 93 feet of the <br />existing nonconforming setback. <br />d. Reduce the size of the temporary garden center. <br />e. Eliminate parking in the front yard setback and increase <br />front yard green space. <br /> <br />4. That the applfcant has done everything practical to reduce the <br />existing Type IV nonconformities at thfs time. <br /> <br />1) <br /> <br />5. <br /> <br />That because of the location of the existing front retail <br />buildings, the front yard landscapfng cannot be substantially <br />fncreased. <br /> <br />BE IT FURTHER RESOLVED that the applfcation NC-71 is and hereby <br />, recommended for approval subject to approval of LP-201. <br /> <br />Adopted thfs 22nd day of July, 1986. <br /> <br />11m" "', ,h j iJ ffl <~> ,l-.
