<br />" <br /> <br />.- <br /> <br />'-. <br /> <br />Ii <br />II <br /> <br />RESOLUTION NO. <br /> <br />86..40 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />i RESOLUTION MAKING FINDINGS OF FACT AND APPROVING SP-133. <br />,I <br />I <br /> <br />i, <br /> <br />WHEREAS, an application for a special use permit has been made by United <br />'Theological Seminary. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. That an application for a special use permit was filed with the City <br />on March 28, 1986. <br /> <br />2. That the Planning Commission, pursuant to published and mailed <br />notices, held a public hearing on April 15, 1986, all persons present <br />at the hearing were given an opportunity to be heard. <br /> <br />3. That the application for preliminary plat approval was considered by <br />the City Council on April 22, 1986, and that the comments and <br />analysis of City Staff and the Planning Commission minutes and <br />recommendations were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council tha the following <br />Findings of Fact are made in respect to SP-133: <br /> <br />i! <br /> <br />1. That the applicant was granted a special use permit December 23, 1974 <br />under SP-58 to construct a Seminary Campus in an R-l zoning. <br /> <br />2. That the applicant Is requesting an amendment to the original <br />special use permit to revise the Seminary Master Plan. <br /> <br />3. That the proposed site of the Seminary will be reduced from 34.86 <br />acres to 11.22 acres. <br /> <br />4. That the 11.22 acres of land is sufficient for the United Theological <br />Seminary to construct all structures and facilities planned for <br />completion of the institution with a planned maximum enrollment of <br />300 students. <br /> <br />5. That the existing Career Development Center on Lots 6 and 7, Block 3, <br />Seminary Estates is included in SP-133 and is compatible with the <br />existing residential area and the plat for Seminary Estates, PL-147. <br /> <br />6. That the revised plan for the Seminary is consistent with the <br />Comprehensive Plan which states development shall be compatible with <br />the existing residential area. <br /> <br /> <br />7. That the revised plan for the Seminary is consistent with the special <br />use standards in Section 8-130 of the New Brighton Zoning Code. <br /> <br />BE IT fURTHER RESOLVED that the application SP-133 is and hereby <br />Ii approved subject to the following conditions: <br /> <br />1. Approval of preliminary PL-147 and subject to final grade <br />plans being presented at time of final plat approval. <br /> <br />2. That the maintenance building be setback a minimum of 30 feet from <br />street right-of-ways. <br /> <br />3. That the applicant submit a revised Master Plan reflecting the <br />current proposal. <br /> <br />4. That educational buildings are structures not exceeding two stories <br />in height and containing classrooms. libraries counseling services, <br />eating and cooking facilities, administrative offices, and all indoor <br />facilities necessary, usual or Incidental to education exclusive of <br />housing. A Chapel may be placed in the area designated for <br />educational buildings and shall not be restricted to two stories in <br />height and may not exceed 40 feet in height overall. <br /> <br />;) <br />
