<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />January 23, 1996 <br /> <br />Page 6 <br /> <br />Public HeariI-w - Liquor License - Maharaja Restaurant - 7:59-8:00 p.m. <br /> <br />Police Chief John Kelley presented the request for an on-sale liquor license for the <br />Maharaja Restaurants DBA Chutney Bar and Restaurant, 2321 Palmer Drive. The <br />Police Department has conducted a background investigation and found no reason to <br />oppose the issuance of this license. The hearing notice was published in the ~ <br />Bri~hton Bulletin and all fees have been paid and proof of insurance has been submitted. <br /> <br />There were no comments from the audience. <br /> <br />Motion by Gunderman, seconded by Williams, to CLOSE THE PUBLIC HEARING. <br /> <br />4 Ayes - 0 Nayes, Motion Carried. Hearing was closed at 8:00 p.m. <br /> <br />Motion by Gunderman, seconded by Larson, to APPROVE ON-SALE MEDIUM <br />RESTAURANT LIQUOR LICENSE TO MAHARAJA RESTAURANT, INC. DBA <br />CHUTNEY BAR AND RESTAURANT LOCATED AT 2321 PALMER DRIVE, <br />NEW BRIGHTON FOR THE PERIOD OF JANUARY 23, 1996 THROUGH <br />DECEMBER 31, 1996; AND IF NECESSARY TO PRO-RATE ACCORDING TO <br />ORDINANCE THE LICENSE FEE DEPENDING ON DATE OF OPENING. <br /> <br />4 Ayes ~ 0 Nayes, Motion Carried. <br /> <br />The Chutney Bar and Restaurant owners confIrmed that the food served at the restaurant <br />will be Indian and American food. <br /> <br />Council Business <br /> <br />Mattila presented the Point of Sale Program. Over the past several months, the Housing <br />Committee received input from the City of Bloomington and local realtors. After <br />review, the Committee recommends the City not adopt a Point of Sale Program at this <br />time. However, the Committee did feel it would be worthwhile to reinvestigate the <br />program in the future and examine the licensing of single family rental housing. <br /> <br />Williams asked what objections did the Committee and the realtors express. Mattila <br />outlined the City of Bloomington's program which was presented to the Committee and <br />realtors. The program entails: inspection at point of sale to disclose problems and <br />correction.'l of life hazard items; 60 % of homes require reinspections for corrections; <br />absences of smoke detectors and backtlow preventors are most common; highest cost <br />incurred by seller is to replace furnace; public education about the program encourages <br />home sellers to tix problems before identified by an inspector; many non-hazardous <br />items are fixed in negotiations between buyer and seller; and no severe structural <br />problems were identified and no homes condemned or required a structural engineer. <br /> <br />Mattila noted that nine realtors voiced opposition. Their main points were: only 3-5 % <br />of New Brighton housing would be affected; inspection redundant since most buyers hire <br />an inspector or receive HUD, FHA or V A appraisals; City inspectors not as thorough as <br />private inspectors; home buyer/sellers may not be able to afford repairs; extra intrusion <br />and cost mandated by government; very little housing blight in New Brighton; and if <br />problems exist they are often in renter occupied housing.
