<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />November 28, 1995 <br /> <br />Page 3 <br /> <br />Public Hearin~ - 7:45-7:47 p.m. - Kindercare - PL-222/LP-306 <br /> <br />City Planner Erny Mattila said the applicant, Kindercare, requests continuation of <br />the public hearing for the minor subdivision and site plan to the December 12 <br />meeting. The applicant is awaiting word from the property owners to the south of <br />the site regarding the proposed access road. Mattila notified the adjacent property <br />owners of the continuation. <br /> <br />Motion by Samuelson, seconded by Larson, to CONTINUE THE PUBLIC <br />HEARING FOR PL-222 AND CONSIDERATION OF LP-306, TO THE <br />DECEMBER 12, 1995, CITY COUNCIL MEETING. <br /> <br />4 Ayes - 0 Nayes, Motion Carried. <br /> <br />Council Business <br /> <br />Mattila presented the proposed amendments to the City's Massage Ordinance. <br /> <br />On November 14, Council directed staff to review ordinance amendments to allow <br />massage as a principal and accessory use in commercial and industrial districts if the <br />massage therapist has more than 500 hours of study; and as an accessory use to <br />barber shops, and beauty and cosmetology salons, in commercial and industrial <br />districts, if the massage therapist has more than 150 hours of study. The principal <br />use to the massage accessory use would be required to comply with the original <br />provisions pertaining to dollars invested in the building and equipment, number of <br />years in business, nwnber of employees, and the amount of tloor area dedicated for <br />massage. The amendment would allow for therapeutic massage at bona fide health <br />clubs such as the Family Service Center. <br /> <br />Samuelson asked if different terminology could be used to replace Massage Parlor <br />in the ordinance. City Attorney LeFevere is unsure how often that word appears, <br />but there is no reason why a preferred term cannot be used in its place. Nancy <br />Higgens, massage therapist, suggested the term, Therapeutic Massage Center . <br />Gunderman questioned if changing the wording could require licensing of the <br />business. Samuelson asked if the term therapeutic massage center would instill <br />that some type of licensure is needed for the business itself. LePevere is unsure <br />whether the rewording could create problems. Mattila noted there are many types <br />of massages available, and asked if Council prefers the massage parlor definition <br />be cemoved fcom the ordinance. LePevere feels the definition would cemain, but <br />the term massage parlor would be replaced. Higgens dislikes the term massage <br />parlor, and the investigative licensing procedure requirements. LeFevere stated <br />that according to the current ordinance, illegitimate massage is not allowed or <br />permitted within the City. <br /> <br />Williams asked if the term massage salon could be used. Larson agrees there are <br />many types of massages and feels the term salon may be lacking. Higgens noted <br />the many styles of massage. Williams questioned whether if not all massages could <br />be considered therapeutic, and asked if there is a consensus amongst Council for the <br />term therapeutic massage salon.
