<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />November 28, 1995 <br /> <br />Page 4 <br /> <br />Council Business. continued <br /> <br />Higgens presented her recommendations in written form to Council and staff. <br />Council and staff requested time to research and review Higgen's recommendations <br />and asked that the issue be deferred to the next Council meeting. <br /> <br />Motion by Williams, seconded by Samuelson, to CONTINUE THE <br />CONSIDERATION OF THE AMENDMENTS TO THE MASSAGE <br />ORDINANCE TO THE DECEMBER 12, 1995, COUNCIL MEETING. <br /> <br />4 Ayes - 0 Nayes, Motion Carried. <br /> <br />Mattila presented for consideration the moratorium ordinance on billboards. <br /> <br />On November 21, the Planning Commission held a public hearing on proposed <br />amendments to the Billboard section of the Sign Ordinance. Some flaws were <br />detected in the sign ordinance, and the Planning Commission felt the areas referring <br />to setbacks, standards, and height restrictions needed additional review. It was <br />recommended the hearing be continued to allow time to study that section; adoption <br />of a moratorium ordinance for all new billboards; and that moratorium ordinance be <br />extended to March 31, 1996. <br /> <br />LeFevere stated that Council has authority to impose interim or moratorium <br />ordinances for the intent to conduct studies or hearings on proposed amendments. <br />This is a relatively short moratorium and should give the Planning Commission time <br />to review the billboard ordinance and hold the public hearing. Williams supports <br />the moratorimn. <br /> <br />Staff received a request for a sign permit on the former W ooddale Builders site on <br />Cleveland Ave. Staff did not issue a permit to the applicant, Mr. Houck, because <br />there is an existing abandoned house on the site and other buildings located closer to <br />the proposed billboard location than what is allowed in the Sign Ordinance. Houck <br />would like to locate his business on the site; but would need to purchase the <br />residential lot adjacent to the north, rezone it to B-1, and attached it to the site. <br /> <br />Bob Bell, Motor Coach Advertising Company, said the company has options on land <br />which expires before March 31, 1996; and this request would prohibit them from <br />utilizing these options. The tirst moratorium would have expired in December and <br />allowed them to excise their options; but the new moratorium will close them out of <br />this opportunity. He feels Council should go forward with the original moratorium <br />and then make modifications after the December date. LeFevere stated that the <br />moratorium does not prevent anyone from purchasing land options. Mattila <br />contirmed that the Planning Commission wanted additional time to study the <br />ordinance and report back to Council with a recommendation they felt confident <br />about. Williams asked if Bell could extend those options. Bell said the company <br />would need to renegotiate with the property owner. City Manager Matthew Fulton <br />said that language amendments within the sign ordinance may not be as simplistic <br />as they are being portrayed to be.
