<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />October 24, 1995 <br /> <br />Page 6 <br /> <br />Council Business. continued <br /> <br />Mattila presented an application from Belair Builders for a special use permit to <br />excavate 88,000 cubic yards of soils from a 4.5 acre site located NW of Rush Lake. <br /> <br />The permit ensures the activity will not have a negative impact on surrounding uses. <br />The storage yard is used for stockpiling sand, soils, concrete and bituminous material. <br />The activity would generate 4 to 6 daily truck trips, and the traffic would not be <br />noticeable. The trucks travel north from the excavation site, across the railroad ROW, <br />onto Belair's site, and out to Old Hwy 8. Traveling south of Hwy 96 will be <br />discouraged, and the activity will not be visible. Belair's site is located north of the <br />railroad tracks which are immediately north of the excavation site. <br /> <br />The City, U.S. Army, MPCA, Rice Creek Watershed District, and Ramsey County are <br />reviewing the plans. Also, the Audubon Society identified the southwest cornef as a <br />protected area, and Belair will leave the area undistufbed. Ramsey County will <br />purchase the 11 acre site and then lease the 3 acre site to Belair for 5 years. Belair <br />would automatically be liable for any contaminated soils deposited on site, and Braun <br />Intertec would test soils brought into the site. The access road to the site would be <br />watefed and swept once a day or as needed. Belair is working with MPCA to cap not <br />only the 5.49 aCfes but also the northern portion of the U.S. Army's railroad ROW, and <br />the Old Herbst LandfIll. Belair will need to apply fOf a permit priof to hauling in fill for <br />the capping project. <br /> <br />Samuelson asked what type of material will be hauled. Mattila said construction soils <br />such as clay will be brought in and then sand will be excavated. <br /> <br />Mike Murlowski, Belair, said they will sign a five year lease with the County to <br />participate. Benke asked if Murlowski had knowledge about the excavation activity at <br />County Road E and Silvef Lake Road. Murlowski recalled that the contract was never <br />finalized and Belair has not been involved in any activity on this site. <br /> <br />Motion by Samuelson, seconded by Larson, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION APPROVING SP-188. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Mattila presented three amendments to the Massage Ordinance. <br /> <br />The tirst amendment relates to expanding the primary use list to include cosmetology <br />salons. Staff was contacted by a business requesting to provide massage at a manicurist <br />shop. The ordinance allows massage as accessorary uses in established and licensed <br />barber shops, or hair or beauty salons. Under State licensing, manicurist shops are <br />licensed as cosmetology shops. In order to practice in manicurist shops, the language <br />or licensed cosmetology shops would be added to the primary uses. The second <br />amendment allows massage in B-2, Neighborhood Business District. Massage is <br />allowed as an accessory use in B-3 district and industrial districts, and there is a <br />manicurist shop located in a B-2.
