Prior to 1991, the drive ended in a cul-de-sac in front of <br />the building. When Innsbruck Park Estates was approved, the cul-de-sac was removed <br />and Black Oak Drive was connected to the service drive. A large section of the cul-de- <br />sac right-of-way (ROW) now remains located in front of the nursing home. The ROW <br />is not improved, serves no public purpose, and contains no utilities. <br /> <br />There were no comments from the audience. <br /> <br />Motion by Larson, seconded by Samuelson, to CLOSE THE PUBLIC HEARING. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Hearing was closed at 8:20 p.m. <br /> <br />Motion by Larson, seconded by Samuelson, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION V ACA TING A PORTION OF THE 1-694 SERVICE <br />DRIVE RIGHT.OF.W A Y. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Council Business <br /> <br />Mattila presented an application for a minor subdivision, non-conforming use permit, <br />and a lot width and lot area variance to create a single family residential lot. <br /> <br />The lot, 603 - I Oth Ave., is made up of three 40 ft. wide lots previously combined. The <br />neighborhood was platted with 40 ft. wide lots, and some remain, were combined or <br />split. The lot depth (126 ft.) is consistent, and any lot with width less than 80 ft. is <br />substandard. The proposed 53 and 67 ft. lots will be substandard, but not out of <br />character with existing lots. A lot width and lot area variance is needed. Parcel A <br />needs a 23 ft. lot width variance and 3,361 sq. ft. lot area variance; parcel B requires an <br />8 ft. lot width variance and 1,463 sq. ft. lot area variance. <br /> <br />The unique circumstance is that several smaller lots with substandard lot area exist, and <br />strict enforcement would cause undue hardship. The inadequate frontyard and rearyard <br />setbacks are unable to correct without removing structures. The lot split would not <br />create additional inadequacies and everything has been done to reduce nonconformities. <br />Staff is requiring a nonconforming use permit so our treatment is consistent for both <br />residential and nonresidential properties. <br /> <br />Benke said the comprehensive planning process involved an area south of City Hall <br />which reserved minimum lot areas of 5,000 sq. ft., and 40 ft. width lots. He asked if <br />there are any other lots with similar circumstances.
