CONSIDERATION OF APPROVAL TO GRANT PERMANENT AND <br />TEMPORARY EASEMENTS ON THE THREE CITY OWNED <br />PARCELS FOR THE SILVER LAKE ROAD RECONSTRUCTION <br />PROJECT AND AUTHORIZE TIlE MAYOR AND CITY MANAGER <br />TO EXECUTE THE EASEMENT DOCUMENTS. <br /> <br />5. <br /> <br />CONSIDERATION OF APPROVAL OF CHANGE ORDERS 1, 2, 3, 4, <br />AND 5, AND THE WORK PERFORMED ON THE CONTRACT FOR <br />PROJECT 92.13, 93-3, AND 93-6 AND TO AUTHORIZE FINAL <br />PAYMENT IN THE AMOUNT OF $96,778.42 TO THE <br />CONTRACTOR, ARCON CONSTRUCTION COMPANY, THE FINAL <br />AMOUNT OF mE CONTRACT IS $493,169.67. <br /> <br />6. <br /> <br />CONSIDERATION OF APPROVAL OF CHANGE ORDERS 1, 2, AND <br />3, AND mE WORK PERFORMED ON THE CONTRACT FOR <br />PROJECT 92-14, AND TO AUTHORIZE FINAL PAYMENT IN THE <br />AMOUNT OF $81,211.24 TO THE CONTRACTOR, ARCON <br />CONSTRUCTION COMPANY, THE FINAL AMOUNT OF THE <br />CONTRACT IS $323,593.31. <br /> <br />3 Ayes - 0 Nayes, Motion Carried. <br /> <br />Public Hearing - 7:39-7:46 p.m. - Storm Sewer Assessments IP/92-8 <br /> <br />City Engineer Les Proper presented the continued special assessment hearing on the <br />storm sewer portion of Project 92-8. <br /> <br />On October 11, public hearings were held on six improvement projects. <br />Assessments for all projects were adopted, with the exception of the storm sewer <br />portion of Project 92-8. At that meeting, several residents questioned the accuracy <br />of the storm sewer assessment map, and felt the backyards on 3rd St. and 9th Ave. <br />NW drained into the storm sewer and should be added to the assessment boundary. <br /> <br />Staff reviewed the assessment map and found it to be accurate, and the backyards do <br />not drain to the storm sewer installed under this project and should not be assessed. <br />The assessment boundary was determined from an orthophoto map which shows the <br />area's contours. The photo shows those backyards drain to the north and east <br />towards Old Hwy 8. Proper walked the backyards to see if there were errors and <br />concluded the map was accurate. The driveways at 1828 and 1848--3rd St. extend <br />into the back half of the lots and could contribute a very small amount; but <br />inclusion of the driveways would have an insignificant effect on assessment rates and <br />would create an irregular assessment line. Proper contacted one resident, Pete <br />Varhol, who felt the map was incorrect and invited Varhol and his neighbors to <br />review the orthophoto map. However, Mr. Varhol was unable to review the map. <br /> <br />Norman Peterson, 1l01--3rd St., feels each property should pay an equal assessment <br />for storm sewer. Proper said the backyards drain into the County Ditch and have <br />paid assessments for ditch improvements. Peterson has also paid for ditch <br />improvements.
