<br />Council Meeting Minutes <br />October 11, 1994 <br /> <br />Page 6 <br /> <br />Public Hearin2. continued <br /> <br />Proper said the subcontractor was hired to televise and assess the lines, however, it <br />was a very poor judgement on their part in not notifying the City immediately when <br />the problem was found. Proper noted that on a bi-annual basis, the City will <br />televise the lines and treat any problems with chemicals. However, a maintenance <br />program will not totally eliminate sewer backups. Gunderman is uncomfortable in <br />taking action tonight, and asked that staff further research the concerns expressed. <br /> <br />City Manager Matthew Fulton explained that the drain appears on the map because <br />this map was used during the feasibility study. The assessments are based on work <br />performed and does not include drains not installed. In regards to a delay in the <br />certifying assessments, Fulton asked Thomson for legal advise. Thomson explained <br />that property owners would still have the ability to pay the assessment in full within <br />30 days after adoption by Council. Proper suggested that Council levy the street <br />assessments at this time and defer the stormsewer assessment for further review. <br /> <br />Gunderman noted the outstanding work performed by staff on many improvement <br />projects, however, this project appears to have more issues and should be deferred. <br />Benke said many concerns have been handled throughout the construction process, <br />but feels the drainage question should be researched. <br /> <br />Williams noted that the biggest question raised tonight was whether those properties <br />north of 3rd St. and east of 9th Ave. should be included in the stormsewer <br />assessment. He suggested that future assessment procedures should utilize the <br />measurements of entire lot dimensions, instead of assessing drainage responsibility <br />in small increments; unless there is a clear drainage line. <br /> <br />Benke asked if moving the drainage line could create legality issues. Thomson said <br />that any benefitting property is required to be notified before the improvement <br />hearing. Because no one from these lots in question is in attendance, he suggests a <br />two week deferral to give staff and himself the time to investigate the issue. <br /> <br />Fulton suggested that Council take action tonight on the street and sanitary sewer <br />special assessment portions and defer decision on the storm sewer assessments to the <br />October 25th Council Meeting. <br /> <br />Because a resident noted problems with a continual root problem, Proper suggested <br />that the City should perform an annual maintenance check on this area's system. <br /> <br />There were no additional comments from the audience. <br /> <br />Motion by Gunderman, seconded by Williams, to CLOSE THE HEARING FOR <br />SPECIAL ASSESSMENTS FOR PROJECT 92--8, Sl'REET <br />RECONSTRUCTION AND SANITARY SEWER REPAIR COSTS. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Hearing was closed at 9:00 p.m. <br /> <br />Thomson confirmed that the prepayment of the special assessments should following <br />the guidelines of the 30 day from adoption by Council. <br /> <br />Public Hearing <br /> <br />I <br /> <br />Special Assessment <br />Hearing Proj.
