<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />October 11, 1994 <br /> <br />Page 7 <br /> <br />Public Hearin~. continued <br /> <br />Motion by Larson, seconded by Samuelson, to WAIVE mE READINGS AND <br />ADOPT THE RESOLUTIONS FOR THE SPECIAL ASSESSMENTS FOR <br />PROJECT 92-8, STREET RECONSTRUCTION AND ORDERING PAYMENT <br />OF THE SANITARY SEWER REPAIR COSTS ON PROJECT 92-8 FROM <br />THE SANITARY SEWER UTILITY FUND; AND CONTINUE THE PUBLIC <br />HEARING FOR THE CONSIDERATION OF THE STORM SEWER RlGHT- <br />OF-WAY COSTS TO THE OCTOBER 25, 1994, COUNCIL MEETING. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Public Hearinl! - 9:00-9:15 p.m. - Project 92-13, Halva's First Addition <br /> <br />Proper said Project 92-13 consists of construction of sanitary sewer, watermain, <br />storm sewer, concrete curb and gutter, and bituminous surfacing to serve 3 lots in <br />Halva's 1st Addition. The area is located at the end of Fairfield Drive north of 5th <br />St. Also included under the curb and gutter and street portion is the property at 601 <br />Fairfield Drive. 601 Fairfield was previously connected to municipal sewer and <br />water and paid a hook-up charge, but has not been assessed for street work. The <br />project involved very high assessment charges because the costs were split between <br />only four lots. Dividing the street cost portion by the 4 lots resulted in a street <br />assessment rate of $7,940.37 per lot. Dividing the total utility portion of the project <br />by the 3 lots resulted in an assessment rate of $19,147.07 per lot. The 3 new lots <br />will be assessed a total of $27,087.44; the existing 601 Fairfield will be assessed <br />$7,940.37. The developer was aware of the possible high assessments costs and <br />decided to go ahead with the project. <br /> <br />Bill Schwartz, 601 Fairfield, said when the home was built years ago, it was most <br />suitable to locate the garag~ closest to Fairfield Dr. He feels it is unfair to assess a <br />property almost $8,000 for an improvement that receives no benefit. Proper said <br />601 Fairfield was derived from a lot split, and in the original staff report, it was <br />stated the lot will be assessed for a future street. Benke questioned if it is correct to <br />apply such a large assessment on 601 Fairfield when the improvement was a request <br />of a developer who opted for improvements. Benke asked if a portion of Schwartz's <br />assessment may be shifted to the other lots. Proper suggested that Council could <br />apply an amended special assessment. Proper noted the Poppyseed Estates <br />assessments which ranged between $5,400-3,600. <br /> <br />In his opinion, Williams does not feel Schwartz would benefit from this new street, <br />and feels some accommodation would be justified. <br /> <br />Proper confirmed that a street assessment has not been paid on this parcel. <br />Larson proposes the 601 Fairfield assessment be changed to $3,600. Proper asked <br />if the remaining portion would then be added to the three other lots. Samuelson <br />asked if the remaining portion could be shared by the City's portion. Proper feels it <br />would be within the City's General Cost to pickup that amount. <br /> <br />There were no further comments from the audience. <br /> <br />Motion by Williams, seconded by Gunderman, to CLOSE THE HEARING. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Public Hearing <br /> <br />Special Assessment <br />Hearing Proj.
