CONSIDERATION OF APPROVAL TO GRANT A NON- <br />INTOXICATING MALT LIQUOR (BEER) AND FOOD LICENSE TO <br />ST. JOHN THE BAPTIST CHURCH FOR SEPTEMBER 18,1994 AND <br />TO WAIVE THE LICENSE FEE. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Public Hearing - None <br /> <br />Council Business <br /> <br />City Engineer Les Proper presented the bid award for Project 94-01, Modifications <br />PGACWTF Addition. The project involves the addition of iron and manganese <br />removal facilities to the existing PGAC Water Treatment Facility and enhanced <br />office facilities. Barr Engineering prepared the plans and specs. Construction will <br />begin this fall with completion next summer. Funding will come from the U.S. <br />Army as part of their ongoing groundwater contamination remediation plan. <br /> <br />Seven bids were received and opened on August 12. Because of a mathematical <br />error, the low bidder, NewMech Companies requested their bid be withdrawn. Staff <br />recommends the bid be withdrawn and awarded to the next low bidder, Penn-Co. <br /> <br />City Attorney Charlie LeFevere said Egan and Sons have questioned the ethicalness <br />of the Penn-Co and Shank bid. Egan submitted a mechanical subcontracting bid to <br />Penn-Co, but Penn-Co chose Shank as their subcontractor. In addition to the <br />subcontracting bid, Shank submitted a general contractor bid. <br /> <br />Tim Sullivan, Egan's Attorney, said legal requirements prohibit collusion in <br />competitive bidding for public contracts. Egan believes there was a relationship <br />between Shank and Penn-Co which affected that bidding. Shank is considered a <br />mechanical subcontractor, not a general contractor. Unbeknown to other <br />contractors, Shank bid the mechanical job to Penn-Co and not to other general <br />contractors. Egan believes this activity put Penn-Co in an unfair advantage.
