<br />Council Meeting Minutes <br />June 28, 1994 <br /> <br />Page 6 <br /> <br />Council Business. continued <br /> <br />This issue had arisen based on a letter submitted by the New Brighton Chamber of <br />Commerce which dealt with the City's current ordinance provisions. The Police <br />Chief discussed these provisions with the City Attorney and found that Sections <br />5-139 and 5-136 are outdated and recommends these sections be brought up to <br />existing conditions. <br /> <br />Section 5~ 136 prohibits compensation to any person in connection with operating a <br />gambling device; and prohibits any person not an active member of the licensed <br />organization, or certain spouses, from operating gambling devices. This section is <br />not in accordance with State Statutes and is violated by several organizations selling <br />pull tabs in the City. If enforced this would create serious problems for local <br />organizations. The Police Chief feels this section should be repealed. <br /> <br />Section 5-139 limits individual play, daily total play and annual total play price <br />amounts for pulltabs, paddlewheels and tipboards. State gambling reports do not <br />report individual or daily play price amounts. The Police Chief feels this section <br />should also be repealed. <br /> <br />The City Attorney will present these recommendations for review by the Council at <br />an upcoming meeting. <br /> <br />Motion by Larson, seconded by Benke, to REQUEST THE CITY ATTORNEY <br />TO PREP ARE AN ORDINANCE REPEALING NEW BRIGHTON CITY <br />CODE SECTIONS 5-136 AND 5-139. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />In regards to the advisory committee reorganization recommendation, Benke <br />suggested this report be given to the Boards and Commissions for their review and <br />comment. He asked the Council and staff liaisons to review this document with <br />their respective commission members at their next most convenient meeting. He <br />feels staff could begin work on organizing the required information needed to <br />implement the recommendation. <br /> <br />Gunderman noted some concern regarding the section relating to term limits. It <br />states that terms shall be structured so that beginning in 1995 existing members <br />would be reappointed for one, two or three years. The longest tenured members <br />would received the shortest term. He is opposed to this section and has heard <br />similar concern expressed by a number of commissioners. He prefers the section be <br />removed from the recommendation. <br /> <br />Benke added that term limits were discussed intensively at the last reorganization <br />meeting. No clear cut decisions were made, and because of this, he suggests the <br />boards and commissions should review these recommendations. <br /> <br />Benke feels the term limit reference may be moot because of natural turnovers <br />within the commissions. He recognizes there is value in an established, <br />knowledgeable and stable base of members for such commissions as the Planning <br />Commission.
