The B-4 <br />district allows a variety of uses, but these uses require a special use permit. Setback <br />requirements are much more flexible in the downtown area than in other districts <br />because the intent is to create a sense of downtown. <br /> <br />Benke noted that several years ago when the City went through its rezoning process, <br />the downtown area was given special consideration to insure that a comprehensive <br />plan was developed. <br /> <br />Dan Dahms, 674 - 4th Avenue. asked how many former businesses will participate <br />in the project. Mr. Ordway has spoke to about four owners regarding interest in the <br />project. Benke noted that staff is keeping the business owners up to date on the <br />development activities. <br /> <br />Motion by Gunderman, seconded by Rebelein, to APPROVE LP~284, SUBJECT <br />TO THE FOLLOWING CONDmONS: <br />1. APPROVAL OF GRADING AND DRAINAGE PLAN BY CITY <br />ENGINEER AND RICE CREEK WATERSHED DISI'RICI'. <br />2. APPROVAL OF LANDSCAPE PLAN AND Bun.DING ELEVATIONS. <br />3. APPUCANT SUBMIT A LEITER OF CREDIT OR BOND <br />COVERING 100% OF THE COST TO INSTAlL CURBING, <br />BITUMINOUS, AND LANDSCAPING ON SITE. <br />4. Motion Carried. <br /> <br />Mattila presented the rezoning of a R-3B, Multiple Family Residential. to R-3BI, <br />Interim Use District, and an Interim Use Permit to locate an office in an existing <br />single family home at 321 Old Highway 8. <br /> <br />To be considered for a rezoning to R~3BI, the site must be currently zoned R-3B. be <br />on a collector road, located adjacent to commercial or industrial districts and be at <br />least 12,500 sq. ft. The site meets those standards, and the Planning Commission <br />recommends approval. <br /> <br />The R-3BI District requires the interim use to meet R~3B sign standards, proposes a <br />parking and landscape plan, complies with City parking ratio requirements, and <br />operates only between the hours of 7:00 a.m. and 10:00 p.m. <br /> <br />Gunderman opposes the application and asked if a date or event has been specified <br />by which the use must be termin:rted. Mattila reviewed the events which would <br />automatically terminate the Interim use Permit. <br /> <br />Gunderman asked if relocation costs would be applicable in regards to termination of <br />the Interim Use Permit.
