<br />Council Meeting Minutes <br />October 26, 1993 <br /> <br />Page 6 <br /> <br />Council Business. continued <br /> <br />Williams understands Gunderman's sentiments, and asked if time limits for <br />termination could be imposed. Mattila said Council has the option to include such. a <br />restriction in the resolution. Williams suggested that the permit not exceed. two <br />years, and be subject to Council review. <br /> <br />Rebelein feels that a time restriction is not needed because the City could clearly <br />terminate a use under those conditions listed in the resolution. Williams feels that <br />those conditions apply only if there is a failure to comply. Rebelein feels the <br />Council has the authority to impose termination. <br /> <br />LeFevere recommends some minor modifications to the resolution relating to: <br />construction of 8 off-street parking stalls, trimming of the existing landscaping, and <br />signage allowed on the subject site. <br /> <br />Gunderman cannot :find one benefit for the City to allow this use. <br /> <br />Benke noted that the previous owner has left the property and the only buyer <br />interested in the site is the applicant. Previously, the Council's majority perspective <br />was that this was an acceptable interim use until such time when the property is <br />redeveloped. Benke would be reluctant to install time restrictions which could make <br />it difficult for the applicant to make a capital investment on any improvements. <br /> <br />Motion by Gunderman, to DENY R-I38 AND I~l. <br /> <br />Motion Died, due to lack of seconded motion. <br /> <br />Motion by Rebelein, seconded by Larson, to WAIVE THE READING AND <br />ADOPr mE RESOLUTION APPROVING I~l WITH THE CONDmONS AS <br />AMENDED AND INCLUDE THAT SIGNAGE COMPLIES WITH R-3B <br />DISI'RICf STANDARDS; AND WAIVE THE READING, HOLD A FIRST <br />AND SECOND READING, AND ORDER TIlE PUBUCATION OF AN <br />ORDINANCE AMENDING TIlE NEW BRIGHTON ZONING ORDINANCE <br />TO REZONE CERTAIN PIlOPER.TY IN NEW BRIGHTON FROM R-3B, <br />MULTIPLE FAMILY RESIDENTIAL TO R-3BI, INTERIM USE DISI'RICI'. <br /> <br />4 Ayes - 1 Nayes (Gunderman), Motion Carried. <br /> <br />Ray Vandermeir, applicant, requested permission to identify the property with <br />signage. Mattila said the R-3B! allows for signage. <br /> <br />Me. Witzke asked why the property was not rezoned to commercial so to avoid <br />placing conditions on the site.
