<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />October '2, '993 <br /> <br />Page 5 <br /> <br />Council Business. continued <br /> <br />City Planner Erny Mattila presented a request for site plan review and <br />nonconforming use permit to construct a 6,400 sq. ft. water <br />treatment/maintenance facility. <br /> <br />Mattila explained that Council continued consideration of the request so to <br />allow staff time to review the exterior storage setback and fencing <br />requirements and the Barr environmental study. Staff met with Barr and <br />Bell Pole representatives to discuss the impact of the study and the fencing <br />and exterior storage requirements. <br /> <br />Mattila outlined the concerns raised in the Barr report and how they will be <br />addressed. A soil sample map suggested that an area of contaminated soil <br />may exist under a portion of the proposed facility; Bell Pole will visually <br />monitor this area as it is excavated and dispose of contaminated soil <br />properly. The City Engineer and Barr Engineering have reviewed the <br />stormwater pollution prevention plan and feel it is acceptable. The drip <br />pads which collect drippage from treated wood is regulated under Federal <br />and State standards and meets those requirements. The Barr report <br />encourages security fencing around the site to prevent access to potential <br />hazards on site. In speaking with Bell Pole. the enforcement of the fencing <br />and exterior storage setbacks standards could create a reduction of 40% of <br />their exterior storage area. Thirty percent of that reduction comes from the <br />elimination of the south site and , 0% would be lost on the main site. As a <br />result, Bell Pole indicates they would suffer a hardship if they were made to <br />comply with the setbacks. The existing maintenance building is setback 8 <br />ft. from the east property line, and the removal of this building would <br />eliminate an existing nonconforming use. <br /> <br />Mattila confirmed that the contaminated soils would be excavated and <br />properly disposed. <br /> <br />Motion by Williams, seconded by Rebelein, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION APPROVING NC-94; AND APPROVE LP-280, <br />SUBJECT TO THE FOLLOWING CONDITIONS: <br />1. APPLICANT PROVIDE STAFF WITH A MAP SHOWING THE <br />PROPOSED SOIL BORING LOCATIONS. <br />2. APPLICANT CONDUCT SIX GEOTECHNICAL SOIL BORINGS IN THE <br />BUILDING FOOTPRINT AND SUPPLY THE CITY WITH BORING LOGS <br />FROM THEIR ENVIRONMENTAL CONSULTANT SHOWING THE <br />PRESENCE OR ABSENCE OF VISIBLY CONTAMINATED SOIL. <br />3. THAT BELL POLE EXCAVATE ALL CONTAMINATED SOIL FROM <br />THE BUILDING FOOTPRINT. <br />4. RICE CREEK WATERSHED DISTRICT AND CITY ENGINEER <br />APPROVAL OF GRADING AND DRAINAGE PLAN. <br />5.
