The petitioners represent more than 50% of the
owners and that portion does not contain public utilities and is not now or
in the future proposed to be improved with a street. The vacation would
still provide adequate right-of-way for the existing cul-de-sac.

Benke noted an area south of the vacation which appears to be excess
right-of-way. Mattila said a petition for vacation has not been received.
Benke asked if the City could initiate vacation. Mattila said the area is an
undeveloped, narrow lot. which if developed. requires a width variance.

There were no comments from the audience.

Motion by Gunderman. seconded by Larson. to CLOSE THE HEARING.

5 Ayes - 0 Nayes, Motion Carried.

Hearing was closed at 7:45 p.m.

Motion by Larson. seconded by Williams, to WAIVE THE READING AND
ADOPT THE RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
THE VACATION OF A PORTION OF THE 16TH STREET RIGHT-OF-WAY.

5 Ayes - 0 Nayes.
