<br />Council Meeting Minutes <br />September 28, 1993 <br /> <br />Page 4 <br /> <br />Council Business <br /> <br />Mattila presented a request for a 12 ft. front yard setback variance to <br />construct a garage and family room onto an existing single family home. <br /> <br />.:: <br /> <br />Due to the steep slope in the backyard and house location, the applicant is <br />unable to construct the garage addition without a front yard variance. The <br />strict enforcement of the ordinance would cause an undue hardship. A 12 <br />ft. frontyard setback variance allows the proposed garage and family room <br />to be constructed 18ft. from the north or front yard property line. <br /> <br />Because of a previous widening of Valley View Lane, many homes along <br />the western cul-de-sac are within 30 ft. of the right-of-way. A previous <br />variance was granted to 2990 Valley View Lane, due to the rear yard's <br />steep slope, and this request involves similarities. The proposed garage and <br />addition would have minimal impact on surrounding uses, and the Planning <br />Commission recommends approval of the variance. <br /> <br />Williams feels the addition would fit in with the neighboring properties, and <br />the variance appears to be legitimate due to the steep slopes. <br /> <br />Motion by Williams, seconded by Larson, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION APPROVING VN-294. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Mattila presented a request to amend the City's Zoning Ordinance by <br />creating a new zoning district which allows for interim uses. <br /> <br />Gary Koss has made a contingent sale of a single family home at 321 Old <br />Highway 8 to an appraiser wanting to locate an office in this home. The <br />site is zoned R-38, Multiple Family Residential and does not permit office <br />uses. The appraisal office would occupy the entire single family home, <br />thereby exceeding the requirements of the Home Occupation Ordinance. <br /> <br />In order for the applicant to use the home for office purposes and not <br />rezone the site, the Zoning Ordinance would need to be amended to allow <br />for offices as an interim use in the R-3B District. An Interim use District <br />document was drafted by the City Attorney. <br /> <br />... <br />~ <br /> <br />An "R-3BI, Interim Use District" allows the use of detached single family <br />homes in the R-3B District on an interim basis for office purposes. To be <br />considered for rezoning to R-381: the single family homes must be zoned R- <br />38, located on collector or arterial road, located adjacent to commercial or <br />industrial districts, and the site must be a least 12,500 sq. ft. in area. <br /> <br />The R-3BI district allows Council to specify a date or event by which the <br />interim use must be terminated. Council may impose conditions on the <br />interim use to protect the health, safety, and welfare of the public.
