<br />Council Meeting Minutes <br />August 24, 1993 <br /> <br />Page 10 <br /> <br />Council Business. continued <br /> <br />Benke verified that rezoning to an Interim Use District would take longer <br />than rezoning to B-1, and asked if B-1 is the ultimate zoning for that area. <br />Mattila said there has been some interest in the site to the east, however, <br />the home site has not been considered in any of those development <br />proposals. Benke feels it may be wise for redevelopment purposes to <br />amend the zoning ordinance for the creation of an Interim Use District. It is <br />agreeable that this property does not function as a single family home <br />anymore. <br /> <br />Williams asked that if an Interim Use District is added to the zoning <br />ordinance, would such a district be applied to other City areas. Mattila and <br />the City Attorney would devise a district which is tailored to this specific <br />site. If there are future requests to rezone to the Interim Use District, <br />Council could consider those at a future date. City Attorney LeFevere <br />verified that the creation of the district is a three step process because a <br />new category is being created. After creation of that category it needs to <br />be rezoned and determined whether interim uses would be appropriate. <br /> <br />Gunderman asked staff to research the possibility of a short term home <br />business expansion use as an interim-use option. <br /> <br />Rebelein feels the interim-use requirements should be written so to make it <br />more difficult to locate an office in dense residential areas. <br /> <br />LeFevere said in regards to the concern that public acquisition may be more <br />costly because of the rezoning; one of the limitations of the Interim Use <br />District is that the use would not impose additional public cost if it is <br />necessary to purchase the property in the future. Gunderman questioned <br />whether a property appraisal would be applied to its current use or after the <br />office improvement. <br /> <br />LeFevere said there is no entitlement to continue the use as a business, and <br />the Initiation of Condemnation terminates the right of the property's use as <br />a business. <br /> <br />Benke said it is not his intention to rezone the property to B-1. <br /> <br />Rebelein feels it is important to maintain the quality of the buildings which <br />might not otherwise have been kept up. She feels this is a positive option <br />for the use of this home. Mattila verified that the house will be kept in its <br />residential character, with the exception of the off-street parking and <br />additional landscaping. <br /> <br />Benke noted that the house is in a livable condition and the proposed buyer <br />intends to maintain the property. <br /> <br />Gunderman asked if the property needed to be updated to meet code <br />requirements. Mattila said the City's Building Official inspected the home <br />to determine if any expensive modifications are needed before it is <br />converted into a home.
