CONSIDERATION OF APPROVAL TO AWARD THE BID FOR <br />PROJECT 93--2, NORm INNSBRUCK DRIVE BITUMINOUS <br />RESURFACING, CONTINGENT ON STATE AID APPROVAL, TO <br />MIDWEST ASPHALT IN TIlE AMOUNT OF $95,845.65. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Public Hearin~ - 7:35-7:38 p.m. <br /> <br />City Planner Erny Mattila presented a request to vacate a utility easement in the <br />Innsbruck Park Estates Third Addition development. <br /> <br />A portion of the existing 8 inch sanitary sewer pipe is proposed to be relocated <br />further west to allow for construction of a two-family home as platted under the <br />Innsbruck Park Estates III addition development. A new easement would be platted <br />over the proposed sewer pipe. The City Engineer has no objection to vacating that <br />section since the sanitary sewer pipe would be rerouted. <br /> <br />Benke verified that the developer will bear the relocation costs. <br /> <br />There were no comments from the audience. <br /> <br />Motion by Gunderman, seconded by Williams, to CLOSE THE HEARING. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Hearing was closed at 7:38 p.m. <br /> <br />Motion by Williams, seconded by Gunderman, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION VACATING THE UTILITY EASEMENT. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Council Business <br /> <br />Mattila presented a request for final plat and PRO approval to construct 7 two-family <br />homes in the 27th Avenue and Linden Drive area. <br /> <br />The final plat complies with conditions of the preliminary plat approval and zoning <br />and subdivision Ordinances. The final grading plan has been approved by the City <br />Engineer and Park Director. Rice Creek Watershed District has issued a permit. <br />The Planning Commission has reviewed the request and recommends approval. <br /> <br />Benke received comments from residents who live along 12th Avenue who noted <br />concern regarding the removal of trees in the construction area. <br /> <br />Mattila said the construction of a retention pond on the site's northern portion <br />required some tree removal. The City Forester identified which trees to be saved <br />and which trees would be removed because they were diseased or dying.
