Mattila said the City Engineer and Park Director have <br />reviewed and approved the grading and drainage plan. <br /> <br />Motion by Williams, seconded by Larson, to GRANT FINAL PLAT AND PRD <br />APPROVAL FOR PI.r202, PRD-56. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Mattila presented an application for a special use permit, nonconforming use permit, <br />and site plan review to construct a service station canopy ten feet from the Silver <br />Lake Road right~f-way. <br /> <br />On July 20, the Planning Commission held a public hearing and recommended <br />approval of LP-277, SP-179 and NC-92. <br /> <br />The proposed canopy with a 10 ft. setback from Silver Lake Road would need to <br />comply with the following: establishment, maintenance or operations will not be <br />detrimental or endanger public health and safety; will not be injurious to the use and <br />enjoyment of other property in the immediate vicinity nor substantially diminish <br />property values; will not impede the development and improvement of surrounding <br />properties; provide adequate utilities, roads, and drainage; and shall conform to <br />district regulations. <br /> <br />The existing station was constructed with a driveway and parking area 10 ft. from <br />the north property line. The current setback for drives and parking areas is 25 ft. <br />The existing encroachment is not detectable from the residential district to the north <br />because of the privacy fence and evergreen screen and this screening should continue <br />around the northeast corner where a gap in the screen currently exists. <br /> <br />The improvements would allow the applicant to update the existing service station <br />and increase the effectiveness of the screening. <br /> <br />There was some discussion regarding the proposed screening of the north property <br />line from the townhome units. Mattila said because the ordinance provides for <br />screening of commercial uses, the intent is not only to close off this small area, but <br />provide some visual buffering to the townhomes. <br /> <br />Larson said the Planning Commission discussion included statements from townhome <br />residents who requested access from between the townhomes and the station for entry <br />to the shopping center and other businesses.
