To amend the plan, the <br />Planning Commission must hold a public hearing. <br /> <br />The proposed office complies with minimum standards of the B-1 district and <br />parking standards. The landscape plan would improve the site appearance <br />and screen the development from the homes. The garage parking area would <br />be fenced and paved, if vehicles are stored, a 5 ft. fence would be added. <br /> <br />Benke noted that in dealing with residential areas near high volume streets or <br />freeways, the City requires a buffer. Rezoning the area to B-1 involves the <br />least extensive business use, and also provide a buffer for adjacent parcels. . <br /> <br />The Council may desire to rezone the area to B-1, but staff would <br />recommend against two different zoning districts between parcels. <br /> <br />Gunderman asked what type of truck storage would be located at the site. <br />Mattila said the garage area would serve as a drop off for deliveries and no <br />equipment or vehicles would be stored. Staff recommended that a 5 ft. <br />opaque fence be installed if vehicles would be stored. <br /> <br />Rebelein asked what effect would a rezoning have on the homestead's <br />property value. Mattila spoke with persons familiar with property evaluation <br />and most felt that if the area contained B-1, R-3A, and R-2 zonings, it would <br />create a challenging marketing situation. Rebelein asked what would happen <br />if the entire area was rezoned to B-1. Mattila said the homestead would <br />become a Type II non-conforming use. <br /> <br />Mattila noted that if Council approved the homeowner's ability to expand the <br />house, the owner could live there for many years. Rebelein asked if the <br />homeowner would be able to sell the home if it were zoned B-1. Mattila said <br />the property could be attractive commercially, but there may be problems <br />marketing it as residential. Also, a title company may have difficulties with <br />the non-conforming use issue. <br /> <br />Tom Wegleitner, Wooddale Builders Realtor, said the proposed building is <br />designed to tIt in with surrounding properties. Several appraisers have said <br />that if the house was rezoned to B-1, the homeowner would be able to sell it <br />commercially. If it were not rezoned, the proposed building appears to be <br />attractive to potential buyers than the site's existing use. Either way it would <br />be a challenging sale and he feels the applicant should keep the R-2 zoning. <br /> <br />Steve Schweiters, Wooddale Builders, would like to expand his business in an <br />area with freeway access. He said the properties along the freeway should be <br />rezoned to B-1, and feels it would be difficult to find three interested parties <br />wishing to build homes on that site.
