'993 <br /> <br />Page 1 2 <br /> <br />Council Business. continued <br /> <br />LeFevere said staff looked at other criteria in which to protect the City from <br />inappropriate businesses. It would be difficult to regulate music in a barber <br />shop or hair salon. Staff tried to eliminate ordinance provisions which <br />would create problems for a business which has a large investment. <br /> <br />Rebelein said many legitimate businesses have therapeutic massage. <br />however. Council needs to be careful when amending the ordinance. <br /> <br />LeFevere confirmed that the licensing provisions remain intact to protect <br />the City from inappropriate businesses. Benke said the entire ordinance <br />does list each activity which is not allowed. <br /> <br />Gunderman asked the applicant what sort of music is used. The applicant <br />said only comfortable and soothing music is used. <br /> <br />Mattila and LeFevere reviewed the existing ordinance and provided the <br />applicant with a copy. Mattila found that previous requests have been from <br />established hair salon or barber shops. LeFevere said upon an ownership <br />change the new owner would not need to wait an additional three years for <br />a license. <br /> <br />Janie Farbreau. Basics for Hair owner. her shop offers many services and <br />the massage therapist is well respected. They are moving the shop <br />upstairs. and feel this is an opportunity to provide this excellent service and <br />will comply with the ordinance. <br /> <br />LeFevere said part of the application process is that staff make an <br />assessment of the operation. He recommended an amendment to the <br />section referring to location; and suggested it to read that a business would <br />need to be located within in the City for at least three years. Benke <br />recommends this change. <br /> <br />Kim Flynn. Basics for Hair. feels providing this service to clients will allow <br />them to keep their business. She would not put her business on the line for <br />a service which is not beneficial or unsafe. <br /> <br />A Basics for Hair client said she has known the massage therapist for 7 <br />years and is highly recommended. <br /> <br />Motion by Gunderman, seconded by Larson. to GIVE A FIRST AND <br />SECOND READING AND WAIVE THE READINGS OF AN ORDINANCE <br />AMENDING CITY CODE SECTIONS 15.197. 15.199. AND 15.204. <br /> <br />5 Ayes - 0 Nayes. Motion Carried. <br /> <br />The applicant asked if the ordinance includes only one particular therapist or <br />could they hire another employee. leFevere will need to investigate. but <br />does not recall whether additional therapists need to go through an <br />investigative process. <br /> <br />Council Business <br /> <br />Massage Ordinance <br />Report 93.'25 <br />
