<br />s (the "Applicant") to be considered for [mal overall Planned Unit Development approval,
<br />of a Final Plat for the area known as Tract 1, and approval of a Special Use Permit to establish a
<br />ensive Sign Plan by the City Planning Commission.

<br />, an application was made by the City of New Brighton in January of2006 to rezone the Planned
<br />elopment area from MX, Mixed Use to R-3A, Multi-Family Residential.

<br />, the procedural history of the applications are as follows:
<br />n application for a site plan review, preliminary plat, and preliminary planned unit development
<br />as filed with the City of New Brighton on December 29,2005,
<br />
<br />he City of New Brighton filed an application for rezoning from MX, Mixed Use to R-3A, Multi-
<br />amily residential (RZ2006-005),
<br />
<br />ublic hearing notices for a site plan review, preliminary plat, preliminary planned unit
<br />evelopment and rezoning were published in the New Brighton Bulletin on January 4,2006.
<br />
<br />he Planning Commission, pursuant to published and mailed notices, held a public hearing with
<br />egard to the site plan review, preliminary plat, preliminary planned unit development, and
<br />ezoning on January 17,2006 and voted to continue the public hearing until January 31, 2006.
<br />
<br />n January 31, 2006, the Planning Commission continued the public hearing, considered the
<br />pplicant's plans and recommended preliminary site plan approval, preliminary plat approval,
<br />reliminary PUD approval, and a rezoning subject to conditions.
<br />
<br />n February 28, 2006 the City Council reviewed the site plan, preliminary plat, and preliminary
<br />lanned unit development and approved the request subject to conditions,
<br />
<br />n February 28,2006 the City Council reviewed the rezoning request and recommended that it
<br />e tabled until submission of a final planned unit development and [mal plat application.
<br />
<br />application for final planned unit development, [mal plat, and special use permit was filed
<br />ith the City of New Brighton on July 28, 2006.
<br />
<br />ublic hearing notices for [mal planned unit development review, final plat, and special use
<br />ennit were published in the New Brighton Bulletin on August 2, 2006.
<br />
<br />he Planning Commission, pursuant to published and mailed notice, held a public hearing on
<br />ugust 15, 2006 and voted to approve the request subject to conditions,

<br />he City Council reviewed the request on August 22, 2006,
