<br />3, he City Council supported the rezoning to R-3A at a meeting held on February 28, 2006 but <br />bled the request to allow the rezoning to be accomplished in phases and in conjunction with <br />ture final plat applications by the Applicant. <br /> <br />4. he City has received a proposal by Applicant for final overall planned unit development <br />proval, fmal plat of the area known as Tract 1, and a special use permit in connection with a <br />ousing redevelopment project of approximately 674 units to be located on the west side of Old <br />ighway 8 NW within the Northwest Quadrant. <br /> <br />5. nder a Planned Unit Development approval process, increased density, height and land uses are <br />viewed and considered. <br /> <br />6. ection 7-220 (2) (C) (2) establishes the following final PUD submission requirements: <br /> <br />a. If a subdivision is part of the proposed planned unit development, all data required <br />for a final plat according to Chapter 26 of the City Code. <br />b. A final plan containing all information required for a building permit in Section 8- <br />010 ofthe Zoning Code. <br />c. A copy of all deed restrictions, covenants to be recorded as part of the planned unit <br />development, and provisions for maintenance, ownership, and preservation of any <br />and all common open space. <br />d. If the planned unit development is proposed to be built in stages, the staging shall be <br />described, including the applicant's best available information regarding location of <br />stage areas and beginning and ending times for each stage. <br />7. ection 7-240 establishes the following criteria for Planning Commission and City Council <br />ction on a Planned Unit Development: <br />a, The consistency of the proposed development with the adopted or proposed <br />comprehensive plan for the City. <br />b. The extent to which the proposed development is designed to form a desirable and <br />unified environment within its own boundaries in terms of relationship of structures, <br />patterns of circulation, visual character, and sufficiency of drainage and utilities. <br />c. The extent to which the proposed uses will be compatible with present and planned <br />uses in the surrounding area. <br />d, That the design of the development justifies any exceptions to the standard <br />requirements of the Zoning Code. <br />e. The sufficiency of each phase of the planned development size, composition and <br />arrangement in order that its construction, marketing, and operation is feasible <br />without dependence upon any subsequent unit. <br />f. The burden or impact created by the planned development on parks, schools, streets, <br />and other public facilities and utilities. <br />g. The impact of the planned development on environmental quality and on the <br />reasonable enjoyment of surrounding property. <br />8, he Planning Commission and Council find the Planned Unit Development Criteria of Section 7- <br />20 and 7-240 to be met. <br />9. ection 26-41 establishes the date necessary for final plat. <br />10, he Planning Commission and Council find the final plat criteria have been satisfied for the area <br />own as Tract 1. <br />11. n accordance with Section 9-041 (4), the Planning Commission may recommend approval of a <br />pecial Use Permit for Comprehensive Sign Plans when the following findings can be made: <br /> <br />a. That the sign plan provides sound identification, reduction of clutter, and aesthetic <br />enhancement. <br />b. That the sign plan is sensitive to and compatible with physical circumstances of the <br />site and buildings, <br /> <br />c, That the sign plan is not detrimental to public safety, <br /> <br />d. That the sign plan will not impede the normal and orderly placement of signs on <br /> <br />
