Mattila <br />said there is a setback of 36 feet. Mattila did not feel the addition would <br />cause future traffic concerns. <br /> <br />Motion by Gunderman, seconded by larson, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION APPROVING VN-290; AND APPROVE LP-268 <br />SUBJECT TO THE FOLLOWING CONDITIONS: <br />1. APPROVAL OF GRADING AND DRAINAGE PLAN BY CITY <br />ENGINEER. <br />2. SUBMITTAL OF PROOF AND PARKING LEGAL INSTRUMENT FOR <br />CITY ATTORNEY APPROVAL AND TO BE FILED WITH THE CITY <br />CLERK AND RECORDED AT RAMSEY COUNTY LAND RECORDS <br />DEPARTMENT. <br />3. A BOND POSTED WITH THE CITY IN THE AMOUNT OF 100% OF <br />THE COST TO INSTALL PROPOSED LANDSCAPING, BITUMINOUS <br />AREAS, AND CONCRETE CURBINGS. <br />4. INSTALLATION OF 8 BALLED AND BURLAPPED SUGAR MAPLE <br />TREES HAVE A 2 1/2 INCH DIAMETER BE PLANTED AT 35 FOOT <br />INCREMENTS ALONG OLD HIGHWAY 8. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Mattila presented the Church Upon the Rock application for a special use <br />permit to locate a 40,000 sq. ft. church and school in the Rice Creek <br />Shopping Center and make joint use of existing parking accommodations. <br /> <br />The Comprehensive Plan identifies only three areas in the city capable of <br />accomodating community business districts. The three areas are: Rice <br />Creek Center, Brighton Village Center, and the downtown New Brighton <br />area. The remaining General Business Use areas are located on Silver Lake <br />Road and Co. Rd. D; and a Mixed Use area is located on Old Highway 8. <br />The three community business districts cannot be readily expanded, and it <br />is important that Council consider any use proposed for these areas to <br />make sure it is complimentary to the existing commercial and residential <br />uses. <br /> <br />Staff's position is that if the proposed non-commercial use is located in the <br />subject established commercial area, it would distract from the peripheral <br />and adjacent commercial uses and would not be in keeping with the <br />Comprehensive Plan. It would interruPt the continuity of the commercial <br />uses and create a decline in commercial activity.
