Also, being that Council has requested more information <br />regarding the Silver Lake Road Project, Childs feels this item should be <br />moved to the February 9 meeting. <br />Motion by Williams, seconded by Larson, to REMOVE THE SILVER LAKE <br />ROAD RECONSTRUCTION PROJECT FROM THE JANUARY 26, 1993, <br />COUNCIL MEETING AGENDA, AND MOVED IT TO THE FEBRUARY 9, <br />1993, COUNCIL MEETING AGENDA. <br />3 Ayes - 0 Nayes, Motion Carried. <br />Announcements and <br />Announcements and UpdatesUr)datgg <br />Childs said the number of applicants for the City's Boards and Commissions Board and <br />was overwhelming. As vacancies occur and other needs are identified, the Commission <br />City will attempt to utilize the applicants that were not selected. Applicants <br />Williams asked Kelley to review the City's current penalties for tobacco Tobacco Sales Issue <br />sales ordinance violations. Report 93-012 <br />Kelley noted that the tobacco sting operated in New Brighton last year was <br />not conducted by the City, but a private advocacy group. The City was <br />informed of the sting after it had occurred. The number of tobacco sale <br />violations to minors in New Brighton is much lower than the Metro Area <br />average. <br />Kelley said the sale of tobacco to a minor is a gross misdemeanor under <br />Minnesota law and the maximum penalty is a fine up to $3,000 and a year <br />of imprisonment. Under the New Brighton ordinance, it is a misdemeanor <br />which is punishable by a fine up to $700. Also, under the ordinance there <br />is the ability of the revocation of the license upon Council action. The <br />penalty for vending machines provides for immediate revocation of the <br />license. <br />Childs said the City of Shoreview enacted an ordinance which provides for <br />progressive suspension of a tobacco sales license. He suggested that such <br />a progressive stance could be reviewed by the Citizen Study Commission <br />(CSC) for its feasibility. <br />Williams supported referring the issue to the CSC. <br />Kelley said the St. Paul ordinance involves fines which are increased by the <br />number of violations by a licensee. <br />
