\,

r

I

_I

Council Meeting Minutes
December 29, 1992

Page 2

Consent Agenda - None

Public Hearing - None

Council Business

Police Chief Kelley presented for consideration the annual renewal of liquor
licenses for the period of January 1 .;. December 31, 1993. The applications
include liquor licenses for restaurant, club on-sale, wine and off-sale. All
applicants must pay the required fees, and provide proof of liquor liability
and worker's compensation insurance. To the best of Kelley's knowledge,
all applicants have met those conditions.

Motion by Williams, seconded by Larson, to APPROVE THE RENEWAL OF
LIQUOR LICENSES FOR THE PERIOD OF JANUARY 1, 1993 TO DECEMBER
31, 1993, FOR ADAGIOS, CHAMPPS'. LOS BANDITOS, MAIN EVENT,
SOUTH CHINA ISLAND INN. AND TRI-CITY AMERICAN LEGION; AND
RENEW THE CLUB ON-SALE LICENSE FOR NEW BRIGHTON EAGLES, THE
WINE LICENSE FOR GIUSEPPE'S. AND THE OFF-SALE LICENSE FOR NEW
BRIGHTON LIQUORS; PROVIDED THAT ALL APPLICANTS PAY THE
REQUIRED FEES. AND PROVIDE PROOF OF LIQUOR LIABILITY AND
WORKER'S COMPENSATION INSURANCE.

5 Ayes - 0 Nayes, Motion Carried.

Childs presented for consideration the renewal of license fees for cigarette
vending machines. He noted that Larson had requested information
regarding fees imposed by other communities.

Childs said the present fee is $25, which is comparable to like cities.
However, other cities are looking at increased enforcement of the
restrictions of cigarette sales to minors. The City of Edina is researching a
possible cigarette license fee-supported Police sting operation.

New Brighton could set the license fee at a feasible amount which would
cover the cost for a sting program. The City does not have a current sting
operation, but Kelley and Childs feel that a fee of $100 per license location
could help support such a program.

Larson suggested increasing the license fee to $125 to accommodate the
costs associated with the additional police investigation.

Williams noted that the renewal date for the licenses is April 1, 1993; and
asked Kelley to research the possibility of a fee increase to support
enforcement of the ordinance.

Motion by Rebelein, seconded by Larson, to TABLE THE CIGARETTE
VENDING MACHINE LICENSE FEES TO THE JANUARY 26. 1993, COUNCil
MEETING. IN ORDER TO RECEIVE ADDITIONAL RESEARCH PROVIDED BY
THE POLICE CHIEF.

5 Ayes - 0 Nayes, Motion Carried.

Council Business

Renewal of liquor
Licenses
Report 92-284

Renewal of
Cigarette
Vending Machine
Fees
Report 92-285
