<br />Council Meeting Minutes <br />October 27, 1992 <br /> <br />Page 6 <br /> <br />I <br /> <br />Council Business, continued <br /> <br />Rebelein asked how would the proposed amendments affect an application <br />for a therapeutic massage business, Mattila said this is handled under a <br />separate section of the City Code under licenses. Rebelein noted that this <br />is a legitimate service, and asked if it would be a special use. <br /> <br />LeFevere said the amendments' intent is to clarify and provide procedures <br />for handling of certain use criterias, The special use amendment does not <br />attempt to list all possible special uses. but its sole purpose is to adhere to <br />a constitutional problem where churches were not listed as special uses, <br /> <br />In the Planning Commission's initial consideration of the Church Upon the <br />Rock application, their objection was the placement of a large church and <br />day care center in a small commercial area which would create isolated <br />commercial pockets. This is a legitimate reason for excluding the use from <br />the district, However, churches have additional protection under the <br />Constitution. LeFevere went through the ordinance to find other permitted <br />uses which would have the same effect on commercial activities as <br />churches, Those permitted uses were deleted from the permitted use list <br />and put in the special use section, The new uses in the special use section <br />include churches and schools, however, there may be other uses permitted <br />which are not listed, such as therapeutic massage. <br /> <br />I Benke instructed staff to follow up on the therapeutic massage issue. <br /> <br />Motion by Larson, seconded by Gunderman, to GIVE A FIRST READING <br />AND WAIVE THE READING OF AN ORDINANCE RELATED TO THE <br />PROCEDURE FOR DETERMINING WHETHER A LAND USE IS NOT <br />INCOMPATIBLE WITH OTHER USES IN THE BUSINESS DISTRICT; AND <br />GIVE A FIRST READING AND WAIVE THE READING OF AN ORDINANCE <br />RELATED TO PERMITTED AND SPECIAL USES IN THE RESIDENTIAL AND <br />BUSINESS DISTRICTS OF THE CITY. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Council Busine~:; <br /> <br />Amendments to <br />Zoning Ordinance <br />Report 92-243 <br /> <br />LeFevere presented for consideration the authorization for termination of Bond Sale <br />certain redevelopment contracts in connection with tax increment financing <br />districts # 1-1 0, <br /> <br />I <br /> <br />On September 29, the City awarded the sale of a number of bond issues, <br />one of which were bonds issued to refunds of existing outstanding tax <br />incremental financing bonds. The delivery of these bonds will be the first <br />week of November, In order for the purchaser of those bonds to accept the <br />bonds, they require an opinion from the City's Bond Counsel regarding the <br />bonds' tax exempt status. <br />
