She <br />objects to assessing 55 lots for improvements to 2 lots. Proper said even if <br />100 grates were installed it will not eliminate the problem because the pipe <br />cannot accept more runoff. Benke verified that Proper's calculations <br />suggest the current pipe is inadequate to accommodate the runoff from the <br />entire drainage area. Proper noted that the proposed 30 inch pipe will <br />possess 6 to 10 times the capacity of the 15 inch pipe. <br /> <br />Dee Howe, 1922--3rd St, represents several people unable to attend and <br />asked Council to table the issue so that other options can evaluated. <br /> <br />Rita Englund, 389 Oakwood, said her lot experiences severe runoff several <br />times a year which cause big ruts in her yard. She is appalled that people <br />cannot get together to solve the problem and stop blaming the City or <br />herself. Her home is one of the oldest on Oakwood and never experienced <br />prOblems until the homes on the hill werB built, She objects to a drainage <br />ditch on her lot and feels the proposed 30 inch pipe is the solution. <br /> <br />Rebelein asked the probability of a lawsuit against the developers by the <br />affected properties. City Attorney Charlie LeFevere feels that because the <br />homes are more than 20 years old, the Statute of Limitations has run out. <br /> <br />Williams referenced the resident who felt these two homes should not have <br />been built, however, Mrs. Englund said her house was built before any of <br />the homes on the hill. He reiterated this is everyone's problem. <br /> <br />Benke noted that each Jot has the legal responsibility to take care of a <br />problem of which their lot is contributing drainage. <br /> <br />A resident asked if he will be assessed for improvements to a home on <br />17th Ave. Benke said any resident has the right to request the City to <br />evaluate a problem and if your property drains into this home then you will <br />be notified of a public hearing to discuss the matter. <br /> <br />Paul Englund, 389 Oakwood, is offended that someone suggested installing <br />a drainage ditch on his lot. A ditch would need to be constructed so deep <br />that anyone who steps outside his home would fall into it. He noted the <br />large gully running across his yard which prevents his children from playing <br />outside. The home was built in 1957, and problems occurred when homes <br />on the hill were built.
