<br />I <br /> <br />1 <br /> <br />1 <br /> <br />Council Meeting Minutes <br />October 8, 1991 <br /> <br />Page 4 <br /> <br />Council Business. continued <br /> <br />At a previous meeting, Council requested the exterior storage area comply <br />with required I~ 1 district setback standards. Belair has now provided a <br />revised site plan showing the exterior storage area to be in compliance <br />with the setback standards. <br /> <br />The Minnesota Pollution Control Agency (MPCA) recommends methane <br />monitoring probes with alarms be installed along the east side of the <br />landfill area to detect any movement of methane. Because of the request, <br />Belair wishes to delay tree and shrub plantings until the landfill portion of <br />the site is approved for such activity. If that area is deemed usable for <br />exterior storage, the applicant would approach the City and request a lot <br />split or some extension of the exterior storage area with a permanent <br />landscape screen on the west and north. <br /> <br />Staff found the proposed site plan. special use permit, and lot split <br />complies with City Ordinance requirements and recommends approval. <br /> <br />Williams asked if Belair was denied extension of the storage area to the <br />west, would that suggest the area will not be screened? Mattila said if <br />the extension was denied, Belair would be required to install screening at <br />the setback. <br /> <br />City Attorney Charlie LeFevere recommended a change in the resolution <br />wording in regards to LP-259 terms and conditions compliance. <br /> <br />Motion by Larson, seconded by Gunderman. to WAIVE THE READING <br />AND ADOPT THE RESOLUTIONS APPROVING PL~1 91, SP-164 AND <br />DENYING VN~285; AND APPROVAL AND CONTINUAL COMPLIANCE <br />WITH THE TERMS AND CONDITIONS OF LP-259. SUBJECT TO THE <br />FOLLOWING CONDITIONS: <br />1. RICE CREEK WATERSHED DISTRICT PERMIT APPROVAL. <br />2. INSTALLATION OF METHANE MONITORING PROBES AND ALARM <br />SYSTEM ALONG WEST PROPERTY LINE OF SITE PER MPCA <br />STANDARDS AND RECOMMENDATIONS. <br />3. THE PROVISION OF A BOND EQUAL TO 100% OF THE COST TO <br />INSTALL PAVING. CURBING, AND LANDSCAPING. <br />4. THE PROVISION OF A BITUMINOUS DRIVEWAY UP TO THE <br />NORTHWEST CORNER OF THE PROPOSED BUILDING PER FIRE <br />CODE REQUIREMENTS. <br />5. APPROVAL OF AN CONTINUING COMPLIANCE WITH THE TERMS <br />AND CONDITIONS OF SP~164. <br /> <br />4 Ayes - 0 Nayes.
