Normally a 40 foot setback is required, however, <br />the applicant feels that the odd configuration of the lot and the steep <br />slope to the south created an unique circumstance which places design <br />constraints on the site. <br /> <br />Planning Commission reviewed the proposal and recommends approval. <br /> <br />The development would comply with 1-2 district and parking standards <br />with the exception of the front yard setback for parking areas. <br /> <br />Bob Worthington, Opus. said Opus looks forward to begin construction. <br /> <br />Motion by Gunderman, seconded by Larson, to WAIVE THE READING <br />AND ADOPT THE RESOLUTION APPROVING VN~283; AND APPROVING <br />LP-258, SUBJECT TO THE FOLLOWING CONDITIONS: <br />1. APPROVAL OF GRADING AND DRAINAGE PLAN BY CITY <br />ENGINEER <br />2. RICE CREEK WATERSHED DISTRICT PERMIT APPROVAL. <br />3. REPLACE EASTERN PIN OAK AND AUTUMN PURPLE ASH WITH <br />NORTHERN PIN OAK. <br />4. PROVISION OF A PERFORMANCE BOND EQUAL TO 100% OF THE <br />COST TO INSTALL PARKING. CURBING. AND LANDSCAPE <br />IMPROVEMENTS. <br />5. APPROVAL VN~283. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Community Development Director Kevin Locke said the development <br />agreement between the City and Opus is ready for execution. <br /> <br />The minimum value of the building is $1.9 million. Opus will purchase the <br />property for $2.00/sq. ft. One dollar per sq. ft. of buildable site area will <br />be paid in cash at the property's transfer and one dollar will be deferred <br />until the building is sold within 3 to 10 years. <br /> <br />The project's size and tax value will be more than the other two buildings <br />combined and would increase the annual tax increment generated in TIF <br />District #15 by 150% or $90,000 per year. <br /> <br />Motion by Williams, seconded by Rebelein, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION AUTHORIZING EXECUTION AND DELIVERY OF <br />A CONTRACT FOR PRIVATE REDEVELOPMENT BY AND BETWEEN THE <br />CITY OF NEW BRIGHTON AND OPUS CORPORATION. <br /> <br />5 Ayes - 0 Nayes.
