It may seem <br />reasonable to have a larger setback away from the Mounds View side due <br />to the tractor trailers on the Mounds View side. <br /> <br />Murlowski said Belair will work with Mr. Boemer to enter into some type <br />of ground lease for additional property to the west and would pre-empt <br />the need for the north and west setback variances. Belair has some <br />concerns in regard to environmental issues of the additional 200 running <br />feet, but this could be worked out. <br /> <br />Dennis Trooien, Boemer's Attorney, verified that Mr. Boemer is in <br />agreement to the subdivision and staff's recommended conditions. <br /> <br />Mattila said the site plan and special use requests comply with 1-1 district <br />standards, except for the fact that Belair is requesting the variance for the <br />exterior storage area. Being that staff did not receive previous direction, <br />the appropriate documents have not prepared. Staff will need to prepare <br />the appropriate resolutions for Council review in order to approve the <br />special use permit and subdivision. The resolutions would be available for <br />Council review at the October 8 meeting. <br /> <br />LeFevere said the City will need to address the methane monitoring issue <br />and he will work with MPCA to define these details in order to prepare the <br />conditions of approval. <br /> <br />Williams recommends action be taken to record the ~ maximum <br />amount of storage allowable on the site. Mattila will add this condition to <br />the resolution. <br /> <br />Motion by Gunderman, seconded by Larson, to DIRECT STAFF TO <br />PREPARE THE NECESSARY RESOLUTIONS APPROVING LP-259, SP~164. <br />PL-191; AND THE DENIAL OF VN-285. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Mattila presented an amendment to the New Brighton Sign Ordinance. <br /> <br />On April 5, a complaint was received regarding a non~commercjal opinion <br />sign displayed by a resident. Staff informed the resident the City's <br />Ordinance only allows for non-commercial opinion signs during an election <br />period.
