CONSIDERATION OF APPROVAL TO AUTHORIZE MAYOR AND <br />CITY MANAGER TO EXECUTE PURCHASE AGREEMENT WITH <br />BRUCE BELL FOR THE PROPERTY AT 501 FIRST STREET NW. <br />I <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Public Hearing - None <br /> <br />Council Business <br /> <br />City Planner Erny Mattila presented the second reading to rezone a 4.9 <br />acre parcel, located at northwest corner of Silver lake Road and County <br />Road E from R-1, Single Family Residential to B- 1, limited Business. The <br />parcel is Outlot C of the Wexford Heights plat. <br /> <br />A B-1 district designation allows for business services and office space <br />but does not allow for retail activity. Allowed uses would be dental or <br />medical clinic, professional office, day care, mortuary and montessori <br />school. Uses not allowed in a B~1 would require a special use permit. <br /> <br />B~ 1 zoning requires a 50 foot setback from a R.1 property and 25 feet of <br />that 50 feet be a buffered landscape strip. The off-street parking area is <br />subject to a 30 foot setback from a main right-of-way. The maximum <br />allowed structure height is two stories or 36 feet. Any proposal <br />exceeding the setback or height allowances would be referred through the <br />variance process and final consideration by Council. <br /> <br />Rebelein is opposed to the rezoning and feels it is a mistake to change the <br />zoning without a specific development proposal. Benke would not <br />envision a set of circumstances that would justify a height variance, <br />especially given Council concerns and the parcel's adjacent properties. <br />Rebelein is not convinced that a future variance could come into play. <br /> <br />Motion by Williams, seconded by larson. to WAIVE THE READING AND <br />HOLD THE SECOND READING AND ORDER PUBLICATION OF AN <br />ORDINANCE AMENDING THE NEW BRIGHTON ZONING ORDINANCE BY <br />REZONING CERTAIN PROPERTY WITHIN THE CITY OF NEW BRIGHTON <br />FROM R-1. SINGLE FAMILY RESIDENTIAL TO B-1. LIMITED BUSINESS. <br /> <br />4 Ayes - 1 Naye (Rebeleinl, Motion Carried. <br /> <br />Mattila presented Arcon Development's request for final plat approval of <br />55 single family lots and 4 outlots in the Wexford Heights subdivision. <br />The property is located west of Silver lake Road and north of County <br />Road E.
