Howard asked if it was <br />possible that land for the trails could not be dedicated. Femelius added that easements <br />cannot be recorded on a plat, so one of the conditions of approval is that the Developer <br />grants the City those trail easements for the trails that are shown on the approved plan. <br /> <br />O'Keefe inquired if the finishing exterior materials provided have met with staff <br />approval. Femelius replied that staff has been impressed with that they have seen and the <br />Developers have done a good job in responding to the Design Guidelines that require a <br />mix of materials. He added that the City has not received a copy of the color renderings <br />from Sherman and Associates and staff recommends as a condition of approval that they <br />have to provide that to the City. Greenfield approached the Commission to explain what <br />materials will be used on the exterior of the buildings. <br /> <br />Motion by Baker, Second by Schiferl to CLOSE THE PUBLIC HEARING. <br /> <br />4 Ayes, 0 Nays. <br /> <br />. <br /> <br />Baker stated that the new layout for the housing development is very nice, and likes it <br />better than the other layout. He added that it's a good use of public and private roads <br />and appreciates the additional green space that was added. Howard agreed with Baker, <br />but wants to make sure that the connections to the park are secured; it's what makes this <br />development so unique. Femelius stated that staff has had several meetings with the rail <br />roads to discuss the trail connections, and while there is a verbal agreement with the rail <br />road the next step is to formalize it in a written document. O'Keefe replied that the <br />connection to the park is of great value to this development and it should be used as a <br />basis for the payment of those connections. <br /> <br />. <br /> <br />Motion by Schiferl, Second by Howard to Motion Waive the reading and ADOPT THE <br />ATTACHED RESOLUTION APPROVING THE FINAL PLANNED UNIT DEVELOPMENT, FINAL <br />PLAT OF TRACT 1, AND SPECIAL USE PERMIT ESTABLISHING A COMPREHENSIVE SIGN <br />PLAN SUBJECT TO THE FOLLOWING CONDITIONS: <br />1. Rezoning of the area within Tract 1 to R-3A. <br />2. Any changes to the proposed signage require amendment of the Comprehensive <br />Sign Plan through the Special Use Permit process. <br />3. The proposed Phasing Plan shall be update with each final plat submittal. <br />4. Ramsey County approval of the final plat. <br />5. The applicants enter into a separate agreement with the City on maintenance <br />responsibilities of streets, trails, and common areas. <br />6. Vacation of all unnecessary easements. <br />7. Fire Marshal review and approval of hydrant locations. <br />8. The necessary Rice Creek Watershed District permits are obtained pnor to <br />issuance of any building permits. <br /> <br /> <br />Page 10 of 14 <br />
