<br /> <br />RESOLUTION No. <br />06-057 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />LUTION MAKING FINDINGS OF FACT AND RECOMMENDING ApPROVAL of SP 2006- <br /> <br />W REAS, an application for a Special Use Pennit has been made by Marla Ordway of <br />Pratt Ordway Properties, and <br /> <br />REAS, the procedural history of the application is as follows: <br />1. An application for a Special Use Pennit was filed with the City of New <br />Brighton on June 2, 2006, and <br />2. The Planning Commission, pursuant to published and mailed notices, held a <br />public hearing on June 20, 2006 and all present were given a chance to freely <br />speak at the hearing. <br />3. The City Council reviewed the request on June 27, 2006. <br /> <br />W REAS, the Planning Commission and Council make the following Findings of Fact <br />in respect to SP 2006-010: <br />1. The subject site is zoned B-4, Downtown Business District. <br />2. The applicant is requesting a Special Use Permit to amend the existing <br />Comprehensive Sign Plan governing allowed signage within Main Street <br />Village. <br />3. In accordance with Section 9-041 (4), the Planning Commission may <br />recommend approval of a Special Use Pennit for Comprehensive Sign Plans <br />when the following findings can be made: <br />a. That the sign plan provides sound identification, reduction of <br />clutter, and aesthetic enhancement. <br />b. That the sign plan is sensitive to and compatible. with physical <br />circumstances of the site and buildings. <br />c. That the sign plan is not detrimental to public safety. <br />d. That the sign plan will not impede the nonnal and orderly <br />placement of signs on surrounding properties. <br />4. As specified in Section 8-130 of the New Brighton Zoning Ordinance, no <br />special use shall be recommended by the Planning Commission unless such <br />shall find: <br />a. That the establishment, maintenance, or operations of the special <br />use will not be detrimental to or endanger the public health, safety, <br />morals, comfort of general public. <br />b. That the special use will not be injurious to the use and enjoyment <br />of other property in the immediate vicinity for the purposes already <br />pennitted, nor substantially diminish and impair property values <br />within the neighborhood. <br />
