<br />!' 1;1 <br /> <br />RESOLUTION NO. 85-74 <br /> <br />RESOLUTION ORDERING REMOVAL OR <br />REPAIR OF HAZARDOUS STRUCTURE LOCATED <br />AT 784 FOURTH AVENUE N.W. <br /> <br />WHEREAS, the house located at 784 Fourth Avenue N.W. in the <br />City of New Brighton, Minnesota is in an advanced state of <br />disrepair and is unoccupied; and <br /> <br />WHEREAS, the Council has reviewed the report of the City <br />Building Inspector based upon his inspection of the property. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br />City of New Brighton as follows: <br /> <br />FINDINGS <br /> <br />On the basis of the report presented, together with observa- <br />tions of damage and disrepair at the subject property, the <br />Council makes the following Findings of Fact: <br /> <br />1. The structure is located upon land at 784 Fourth Avenue N.W. <br />in the City of New Brighton, the legal description of which <br />is shown on Exhibit A, attached hereto and hereby made a <br />part hereof. <br /> <br />2. The structure is in a state of disrepair which makes it <br />unfi t for occupancy, a rodent harborage and a nuisance to <br />neighbors in the area. <br /> <br />3. The structure is unoccupied and susceptible to trespass. <br /> <br />4. The structure is in such an advanced stage of damage and <br />disrepair that persons coming into the structure are sub- <br />jected to hazardous conditions including the substantial <br />risk of injury due to falls, defective electrical wiring and <br />light fixtures, and the accumulation of garbage throughout <br />the entire house. <br /> <br />5. That such hazardous conditions must be remedied by removal <br />of the building or repair as described in the attached <br />Exhibit B, which is hereby made a part hereof. <br />
