<br />CONCLUSIONS <br /> <br />Based upon the foregoing, the City Council concludes that <br />the structure located at 784 Fourth Avenue N.W. constitutes a <br />hazardous building within the meaning of Minnesota Statutes 1982, <br />Section 463.15 and as such is a fire hazard and health and safety <br />hazard to the public. <br /> <br />ORDER <br /> <br />Based upon the foregoing, the City Council of the City of <br />New Brighton makes the following Order: <br /> <br />1. The owners of the property located at 784 Fourth Avenue N.W. <br />in the City of New Brighton are hereby ordered to commence <br />razing and removing said hazardous structure within 20 <br />days of the date of the service of this Order and----ro <br />complete razing and removing said structure within 60 days <br />of the date of the service of this Order or to commence <br />repair of said structure as described in Exhibit B within <br />20 days of the service of this Order and to proceed with <br />all due diligence in completing such repairs, which repairs <br />must be completed no later than 180 from the date of <br />the service of this Order. <br /> <br />2. Unless the razing and removing or repair of said structure <br />is commenced and completed as provided above, or an Answer <br />served upon the City in the manner prescribed for the <br />service of an Answer in a civil action, the City shall seek <br />summary enforcement of this Order in the District Court in <br />and for Ramsey County. <br /> <br />3. All costs of such abatement of the hazardous structure and <br />enforcement of this Order which are incurred by the City <br />shall constitute a lien upon the property collectible as <br />provided in Minnesota Statutes 1982, Section 463.21. <br /> <br />4. The City Manager is directed to serve this Order upon the <br />owners as provided in Minnesota Statutes 1982, Section <br />463.17. <br /> <br />5. The City Manager and City Attorney are authorized and <br />directed to bring such enforcement proceedings as may be <br />necessary to secure compliance with this Order without <br />further order of the Council. <br />
