<br />. <br /> <br />RESOLUTION NO. 06- <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION DEFERRING ASSESSMENT FOR 2050 RICE CREEK ROAD <br /> <br />WHEREAS, Public Improvement Project 05-1, Rice Creek Road Reconstruction, was ordered by the City <br />Council of the City of New Brighton at a Public Improvement Hearing, noticed, and held as required by law; <br /> <br />WHEREAS, special assessment 63051000 was adopted by the City Council at an Assessment Hearing to <br />fund a portion of the project costs; <br /> <br />WHEREAS, Minnesota Statute, Section 429.061, provides that cities may defer special assessments for <br />qualifying senior citizens, and the New Brighton City Code, Chapter 2, Section 3, allows the City Council to <br />defer special assessments for qualifying senior citizens; <br /> <br />WHEREAS, the residents of the property at 2050 Rice Creek Road, Property Code 18-30-23-42-0087, <br />New Brighton, Minnesota, have requested that special assessment 63051000 be deferred as described in Chapter <br />2, Section 3 of the New Brighton City Code; <br /> <br />. <br /> <br />WHEREAS, the applicant has meet all the conditions and qualify for a senior citizen deferment as <br />described in the New Brighton City Code and the payment of the special assessment has been deemed a fmancial <br />hardship; <br /> <br />WHEREAS, the principal amount of the assessment to be deferred is $2,269.59; <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council of the City of New Brighton, Minnesota that: <br />1. The special assessment 63051000 levied against the property at 2050 Rice Creek Road is hereby <br />deferred as specified in the New Brighton City Code, Chapter 2, Section 3. <br /> <br />2. Interest shall accrue at an annual rate of six percent per year from the same date as applied to other <br />properties assessed under assessment 63051000 and as described in Resolution 06-096, Resolution <br />Adopting Assessment on Project 05-1, Rice Creek Road Reconstruction. <br /> <br />3. Payment of the deferred assessment will become due as stipulated in Section 7 of Chapter 2 of the <br />New Brighton City Code. <br /> <br />Adopted this 10th day of October, 2006. <br /> <br />ATTEST: <br /> <br />Steve Larson, Mayor <br /> <br />Daniel A.
