<br />Stockmans Restaurant <br />Page #2 <br /> <br />May 23, 1978 - City Council adopts ordinance setting time <br />limit within which a building permit authorized by the Council <br />must be used. This time limit is 180 days. <br /> <br />In those cases where building permits were already authorized, <br />but not yet used, the ordinance states that the 180 days begins <br />when the ordinance was adopted, May 23, 1978. Extensions of <br />this time limit can be approved by the Council, if requested by <br />the applicant. <br /> <br />Mr. Welsch did not take out ~hebuildingpermitin the 180 days <br />following the May 23, 1978 date of ordinance adoption, nor was <br />any extension of the time limit requested by Mr. Welsch. <br />Therefore, according to ordinance the Council authorization for <br />a building permit is null and void. <br /> <br />Lastly, the property is covered by our Ordinance #453 <br />(Moratorium Ordinance) because the existing zonong (B-3 General <br />Business) is in conflict with the proposed land use plan (Low <br />Density Residential). In such a case of conflict Ordinance #453 <br />states that no permits can be issued by the Council. <br />
