Stockmans Restaurant
Page #2

May 23, 1978 - City Council adopts ordinance setting time
limit within which a building permit authorized by the Council
must be used. This time limit is 180 days.

In those cases where building permits were already authorized,
but not yet used, the ordinance states that the 180 days begins
when the ordinance was adopted, May 23, 1978. Extensions of
this time limit can be approved by the Council, if requested by
the applicant.

Mr. Welsch did not take out ~hebuildingpermitin the 180 days
following the May 23, 1978 date of ordinance adoption, nor was
any extension of the time limit requested by Mr. Welsch.
Therefore, according to ordinance the Council authorization for
a building permit is null and void.

Lastly, the property is covered by our Ordinance #453
(Moratorium Ordinance) because the existing zonong (B-3 General
Business) is in conflict with the proposed land use plan (Low
Density Residential). In such a case of conflict Ordinance #453
states that no permits can be issued by the Council.
