<br />~ <br /> <br />LP-98 <br />Page #3 <br /> <br />e <br /> <br />the building were located to the north, soil tests would have to <br />be taken and probably a certain amount of filling would be <br />involved. <br /> <br />Mr. Bogucki noted that the firm would be very willing to negotiate <br />a driveway access with the property owner to the south. <br /> <br />Commissioner Livingston commented that the building should be <br />turned with attractive exterior on the front and rear of the building. <br /> <br />Commissioner Williams noted that he felt moving the building mi~ht <br />complicate drainage problems and generate traffic flow problems in <br />the parking area. Also, he mentioned that the bulk of the proposed <br />building would be more acceptahle adjacent to the development to <br />the south and should not be moved to the north. <br /> <br />Motion by Leverkuhn, second by Williams to recommend approval of <br />LP-98 contingent on the following conditions: <br /> <br />{ <br /> <br />e <br /> <br />1. That final grading and drainage plans be approved <br />by the City Engineer and the Rice Creek Watershed <br />District; <br />2. That a six foot wooden fence setback fifteen (15) <br />feet from the front property line be installed <br />along the eastern property line; <br />3. That the applicant provide for a driveway access <br />for emergency and drainage purposes from the <br />southern property line to be negotiated with the <br />property owner to the south. <br />4. That the applicant conform with site and landscape <br />plans dated and signed by the applicant and City <br />Planner. . <br /> <br />Motion by Livings.ton, second by Sande to add a condition #5. to read: <br /> <br />5. That the applicant move the building to the north and <br />, thereby break up the appearance of the parking lot. <br /> <br />2 Ayes ~ 3 Nayes (Lang, Leverk~hn, Williams), amendment to motion fails. <br /> <br />Motion by Williams, second by ,Livingston to amend condition #3. of <br />the main motion to read: <br /> <br />3. That the applicant negotiate a driveway acce~s and <br />drainage easement from the property owner to the <br />south and that in lieu of the agreement, the applicant <br />undertakes an alternate for access to a hydrant to <br />be reviewed and approved by the Fire Department. <br /> <br />4t 5 Ayes - 0 Nayes, amendment to motion carried. <br /> <br />5 Ayes - 0 Nayes, main motion as amdended carried. <br />
