Staff contends
that in order to meet the intentions of the non-conforming
use permit there are practical measures that could be
taken by the applicant. Those measures include:

\DO
~ \
11.0 ~o

<<' \#-
~.J!)
I; 3.
Jyt 4.

1. Removing a portion of the
on the western portion of
curbing along the western
existing blacktop area in
front yard parking.
Install sod in the area where the blacktop was to
provide more front yard landscaping.
Comply with the conditions of NC-34 and remove all outside
storage of parts and debris.
Agree to maintain the western portion of the property
in the same manner as the other landscpaed areas. The
western area to exist in its natural state can be
considered too natural.

blacktop in the front yard
the site and install concrete
edge of the new drive. The
the front yard only encourages

If these four measures or other similar measures are acceptable
to the applicant, the intentions of the non-conforming use
permit would be met. In regard to the exterior wall treatment,
the applicant is proposing painted standard concrete block
for the office building to match the existing building. It
would seem inappropriate to require decorative block on the
small addition which would not match the existing structure.

BUILDING PERMIT APPLICATION, LP-103

The plans are complete and contain all necessary information.
Consideration of the building permit should be contingent on
approval of the non-conforming use permit (NC-46) and approval
by the Rice Creek Watershed District.

STAFF RECOMMENDATION

Staff recommends that the Board recommend approval of NC-46 by walVlng
the reading and adopting the attached resolution with conditions.

Staff further recommends that the Board recommend approval of LP-103
contingent on the following conditions:

1. Approval and conformance with non-conforming use permit,'
NC-43;
2. That final grading and drainage plans be approved by the
Rice Creek Watershed District and City Engineer; and
3. Conformance with site and landscape plans dated and signed
by applicant and City Planner.
