There is only a small amount of the concrete <br />curbing provided along driveways and parking <br />areas within the front yard. <br />F. Inadequate wall treatment. <br />G. There are materials being stored outside that are <br />unscreened and are visable from the public right- <br />of way. <br /> <br />3. The approved site plan for NC-34 did the following in <br />regard to the aforementioned non-conformities: <br /> <br />A. The entire building was repainted; <br />B. Concrete curbing was provided along the front yard <br />parking lot; <br />C. The front yard area not used for parking was land- <br />scaped with evergreen plantings; <br />D. All outside storage was removed; <br />E. Removed front yard parking on the western blacktop <br />area. <br /> <br />EXISTING TYPE IV NON-CONFORMITIES <br /> <br />1. Lack of concrete curbing in the front yard (around the <br />western' edge of the blacktop on the west side of the <br />site); <br />2. Outside storage of parts and debris on the west side <br />street yard not properly screened; <br />3. Front yard parking less than 15 feet from the street <br />right-of-way; <br />4. Side street yard parking in an industrial district; <br />5. Lack of decorative block on the street sides of the <br />building. <br /> <br />WARRANTS FOR GRANTING NON-CONFORMING USE PERMIT <br /> <br />Section 3-60 of the New Brighton Zoning Code states that <br />before a non-conforming use permit can be granted one or <br />more of the following conditions must be met by the <br />application: <br /> <br />1. The total number of non-conformities is reduced; <br />2. The impact of any non-conformity upon adjacent <br />premises is reduced to the greatest practical <br />extent; and <br />3. The extent of any non-conformity is reduced where <br />practical. <br /> <br />DEVELOPMENT PROPOSED BY THE APPLICANT TO ADDRESS THE NON-CONFORMITII <br /> <br />The site plan presented by the applicant does not address <br />the Type IV non-conformities. By not addressing the <br />existing non-conformities this application does not meet <br />the intentions of the non-conforming use permit. <br />
