Less than required side yard setback; <br />2. Lack of required concrete curbing along western edge <br />of westerly driveway; <br />3. Lack of the required handicapped parking spaces (2 are required); <br />4. Outside storage not properly screened from the public <br />right-of-way; <br />5. Lack of required exterior wall treatment. <br /> <br />The plans submitted by the applicant do not address the <br />forementioned non-conformities. In order to meet the <br />intentions of the non-conforming use permit the existing <br />Type IV non-conformities must be addressed. It would not <br />be practical to require the applicant to relocate the <br />westerly building that does not have the required setback. <br />At this time the applicant cannot install concrete curbing <br />along the westerly driveway because the driveway is located <br />on property owned by the City of New Brighton. <br />
