<br />! <br />I <br />I <br />,I <br />'I <br />Ii <br />" <br /> <br />~" <br /> <br />RESOLUTION NO <br /> <br />NEW BRIGHTON PLANNING COMMISSION <br />BOARD OF REVIEW <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF <br />VARIANCE APPLICATION, VN-215 <br /> <br />i <br />I <br />II <br /> <br />WHEREAS, An application for a variance, VN-215 has been <br />made by Belair Builders to construct an industrial building <br />with less than the required side yard setback. <br /> <br />WHEREAS, The procedural history of the application is as <br />follows: <br /> <br />1. That an application for a variance, VN-215 was filed <br />~ith the City on August 8, 1980. <br />2. That the Board of Review heard and reviewed the <br />application at its regular meeting on August 19, 1980 <br />and September 16, 1980. <br />3. The written comments and analysis of the City Planner <br />and all person1s statements made at the Board of Review <br />meeting were considered. <br /> <br />I <br />II <br /> <br />NOW THEREFORE BE IT RESOLVED by the Board of Review that <br />the following Findings of Fact are made in respect to VN-215: <br /> <br />1. That the property is zoned 1-1, Light Industrial; <br />2. That the lot is only 75 feet in width, which is a <br />relatively narrow lot width in an industrial district; <br />3. That the proposal will be removing a single family <br />home which is a Type II non-conformity; <br />4. That a hardship would result if the driveway width <br />is reduced because it would not be adequate for <br />industrial vehicles; <br />5. That a lesser width for the proposed building would <br />deter from the functional use of the building; and <br />6. That the applicant has attempted to purchase <br />additional property to all~viate the need for a <br />variance. ' <br /> <br />BE IT FURTHER RESOLVED, That the Board of Review recommend <br />approval of VN-215 contingent on the following conditions: <br /> <br />1. That scrubs or other types of landscaping be <br />installed along the 5 foot side yard to accent the <br />building and break up the appearance of the building. <br />2. That there be no outside storage of parts, debris and <br />that all vehicles are currently licensed and operable. <br />3.
